As an easement holder, I have experienced firsthand the challenges and unfair treatment faced by many in our community of Newberry. My easement, a shared pathway intended for safe and mutual utility, has been misused and abused by the landowner lining it with broken toilets, personal trash, metal debris, and even oil poured onto the pavement. These actions not only compromise the safety of those who need to drive down the easement, but also pose significant risks to the environment and the safety of Newberry at large.

I am not alone in this struggle. Speaking with other easement holders, many share similar stories of their easements being used as dumping grounds or obstructed out of spite. Such malicious intent contradicts the spirit of community pride and responsibility that should characterize our shared spaces. Clearly, the current laws do not provide adequate protection or enforcement to ensure fair treatment of easement holders.

Easement holders have a right to safely and fairly utilize their easements without fear of hazardous and degrading conditions. Therefore, we urge lawmakers to consider revising existing regulations governing landowners and easement rights. By implementing clearer laws and stronger penalties for violations, we can ensure accountability and encourage a more harmonious relationship between landowners and easement holders.
