Before a rum distillery is considered at the end of Mahogany Road, the proper permitting process must be followed and the community has a right to a public hearing to ask questions about the environmental impact:

1. The reason why Act 8569(b) is unconstitutional is because the Legislature failed to hold a public hearing
2. The reason why Act 8569(b) is ineffective is because it changes Title 29 VIC Section 225, but it did not change Section 228, which prohibits rum distillation in the A-2 Zone.
3. The DPNR should never have issued the Permits
