More and more these days we have been witnessing the private institution known as the IRS capture our personal data held in confidence without due process of law.

If the IRS where to entrap an individual based on personal data captured, as a standing private Institution, the IRS would be put in a position of being exposed to the due process of law as it pertains to the Fourth Amendment and the search and seizure of personal data.

In fact, any private Institution transferring personal data to another private Institution without an informed and documented allowance of transfer will be deemed in violation of the Fourth Amendment.

In addition, if the other private Institution has without probable cause knowingly violated the Fourth Amendment they too are subject to the full extent of the law based on the fact that a warrant must be issued.

This is not to be misconstrued with information of surveillance within the public space otherwise known as "public viewing" when in fact this is a violation of  "personal data".
