The Issue

County of Orange has the statutory authority to conduct elections per CA Election. Code § 19207.
“The governing board may adopt for use at elections any kind of voting system, any combination of voting systems, or any combination of a voting system and paper ballots, provided that the voting system or systems involved have been certified or conditionally approved by the Secretary of State or specifically authorized by law pursuant to Section 19209.”
The Voter's Choice Act (VCA) has been an abject failure.
This is an "opt-in" program that is coming up for renewal in Orange County in 2025 and can be rescinded. The intent was to improve access to voting, yet it created voting centers that eliminated hundreds of neighborhood voting locations within the county. Election results that used to be in a matter of days, now take over a month.
Other flaws created by this program are outlined below:
- Drop boxes are unmonitored with little to no chain of custody surety.
- Ballots are transported by temporary workers, which may violate the law under CA Election Code § 4103.
- There have been over 6.8M ballots wasted since the Voter’s Choice Act was implemented, forcing taxpayers to foot the bill.
- Extended vote centers cost well over $2.5 million dollars.
- 18K Ballots submitted from other counties in the Nov 2024 election contributed to delayed results, questionable chain of custody and potential for loss and damage.
- Electronic Poll books remote connections over the intranet/internet may violate CA Election Code § 19205 (a) stating “no part of the voting system shall be connected to the internet at any time."
Elimination of Voters Choice Act can start the process to restore greater local control of our voting system and elections.
- In person voting in neighborhood precincts
- 1 day voting
- Paper poll books with live signatures.
- Verification of voter beyond Vote-By-Mail system.
- ID required to help correct inaccuracies / guard against identity theft.
- Eliminate all drop boxes.
