The Issue
🗽Problem- 🧀 Wisconsin previously allowed private citizens to bring qui tam actions for certain false claims against public programs. That authority was repealed. As a result, detection and recovery of fraud on public funds now depends almost entirely on government agencies that may lack resources or incentives to pursue every case. ⚖️ Proposed Solution- ✍️Enact legislation that: 1️⃣Restores private qui tam authority for false claims involving public funds (starting with medical assistance and carefully defined state/local contracts). 2️⃣Allows a private plaintiff who prevails to recover a percentage of the funds returned to the public treasury, plus reasonable costs and attorney fees. 3️⃣Requires the private plaintiff to notify the Attorney General / relevant agency and give the government the first opportunity to intervene. 4️⃣Includes clear definitions, statutes of limitation, and safeguards against abusive filings. ❓Why it matters- 🫵It creates a controlled, incentive-based failsafe that helps recover public money without creating a general private-attorney-general office or unlimited new lawsuits against discretionary government decisions. ⏩Next step- 🙏I am seeking legislators willing to review a draft and consider introduction.
