Restore Our Ditch, Protect Our Rights: Demand Fairness from Jefferson County
The Issue
Hi, I’m Greg Koss, your neighbor in Applewood, across from Rolling Hills Country Club. You might’ve seen me walking my dog or tending to the small irrigation ditch tied to our water rights that have been part of our community since the 1860s. This is personal to me—my yard floods, my rights have been buried, and I’ve faced harassment—all because Jefferson County and a developer let my ditch be destroyed in 2019 for the Cottages at Rolling Hills subdivision, while I’ve spent thousands fighting alone to protect my home and family.
For over five years, I’ve watched heavy equipment bury my ditch, a 50,000-volt transformer land on it, and a broken pipe—installed with no slope—turn my property into a swamp. The County ignored my pleas, approved this mess, and gave me no easement, while bending over backwards for big ditch owners like Coors with dedicated rights. The HOA’s locked me out, neighbors have built over my lateral, and I’ve been threatened just for trying to fix what’s mine—all while raising a small kid and running a business. This isn’t just my fight—it’s about fairness for all of us in Jefferson County.
Colorado law (C.R.S. § 37-86-102) says I have a right to maintain my ditch, but I can’t when it’s under concrete and fences. I need your help to demand:
- Fix the Ditch: Remove the transformer, fences, trees and other encroachments; repair the pipeline and headgate so water flows unimpeded.
- Secure an Easement: Grant me a legal ditch easement, just like Coors got, with HOA accountability.
- End Unequal Treatment: Stop the County from favoring big players while ignoring residents like me.
- Clear My Name: Halt the harassment, threats, intimidation, retaliation and vandalism I’ve faced for speaking up.
