The Issue

We, the undersigned, respectfully ask the Florida Department of Transportation (FDOT) and our elected officials to work with local stakeholders to preserve responsible commercial kayak access to Shell Key Preserve. The public kayak launch in Tierra Verde has long served as a primary access point for reaching Shell Key Preserve, supporting both residents and visitors seeking to experience one of Pinellas County’s most important coastal environments. For years, multiple local kayak operators have used this location to safely and responsibly provide guided eco-tours, environmental education, and public access to the preserve. Recently, the Florida Department of Transportation (FDOT) has designated this launch area as part of the roadway easement, resulting in enforcement actions that prohibit commercial kayak operations from using the public launch. Operators have received warnings and citations, and no alternative launch site currently exists that provides practical access to Shell Key for guided tours. No formal written explanation outlining the full basis or scope of this change has been provided to affected operators. This change has significant and immediate consequences. It affects multiple small businesses, local employment, tourism, environmental education, public access to one of Florida's most unique coastal preserves, and the ability of residents and visitors—many of whom do not own boats or kayaks—to safely access and learn about Shell Key Preserve through guided experiences. We recognize the importance of maintaining safe public roadways and respecting right-of-way regulations. However, we believe that public access to natural resources and responsible commercial eco-tourism can be balanced through thoughtful planning and collaboration. We are not asking for special treatment. We are asking FDOT, Pinellas County, and local elected officials to work with the community and affected stakeholders to review this decision and identify a safe, lawful and practical solution. This may include a designated commercial launch area, a permitting structure, or other reasonable accommodations that preserve both safety and public access. Shell Key Preserve is a shared public resource. This request is about ensuring that access to it remains available in a safe, transparent, and sustainable way for future generations.
