Restore bail/bond for those held by ICE

The Issue

The U.S. immigration system is a complex labyrinth that exerts immense pressure on individuals and families caught in its web. A critical aspect of this system is the ability to post bond, which provides a lifeline for those detained by the Immigration and Customs Enforcement (ICE). Unfortunately, recent policy changes have drastically reduced, and in some cases eliminated, the opportunity for detainees to post bond. We must urgently advocate for the restoration of this critical right.

According to the American Civil Liberties Union (ACLU), many immigrants are detained for extended periods without the chance to post bond, leading to prolonged separation from their families and communities. These individuals , most of whom pose no threat to public safety, and their families, suffer unnecessarily, due to the harsh measures imposed upon them by the current immigration detention policies. More than 25 people have died in ICE prisons since January 2025. They are often subject to abuse and neglect in these privatly run prisons. In addition, most are the main breadwinners for their famililies and prolonged detention leaves families without the ability to pay for basic necessities. 

The option to post bond is not merely a procedural formality; it represents a fundamental aspect of due process and fairness. Statistics reveal that nearly 70% of immigrants in ICE detention are eligible for release on bond, yet only a fraction are granted this opportunity due to heightened restrictions and arbitrary judgments. This disproportionately affects low-income detainees who cannot afford exorbitant bond amounts, leaving them languishing in detention while their cases proceed.

Restoring the ability to post bond for all detainees would not only uphold the principles of justice but also alleviate the financial and emotional toll on families and communities. Immediate action is necessary to correct these injustices and bring humanity back into the heart of immigration proceedings.

We urge lawmakers and authorities to take immediate steps to revise current policies and practices allowing ICE-held detainees the opportunity to be released on bond. Doing so is a compassionate and just solution that aligns with our nation's foundational values of liberty and justice for all.
