Require grand jury and special counsel for criminal cases
The Issue
On May 29, 1996, in a harrowing experience that nearly ended my life, I was trapped in a vehicle with a suspect—an individual accused of severe corruptions such as fraud, misrepresentations, drug distribution, and money laundering. This suspect tried to kill us by dangerously driving at speeds between 90 mph to 140 mph, slamming on the brakes suddenly, resulting in a broken neck for one of the victims.
This experience reflects a broader systemic issue where individuals with influential power misuse their positions to obstruct justice, sidestepping fair due processes that are the bedrock of our legal system. It is critical that in all infamous crimes, such as murder or attempted murder, we require the establishment of Grand Jury Investigations and the appointment of Independent Special Counsel, especially in Hawaii and other states. This measure is necessary to prevent any conflict of interest that allows high-profile suspects to influence outcomes unjustly.
Current frameworks often inadequately address or fail to protect victims' rights. Victims' information, credibility, and narratives must be at the forefront, especially when heinous crimes are involved. The Fifth and Fourteenth Amendments of the United States Constitution guarantee the right to due process and equal protection under the law. We should ensure these rights are upheld by establishing unbiased, impartial investigations that fearlessly uncover the truth.
The inclusion of Grand Jury Investigations serves as a safeguard that can deeply examine the evidence without the taint of political or personal influences. Special Counsel can also be instrumental in providing an independent investigative pathway that reports transparently on findings, without the pressure from local influences that might otherwise skew results.
