The Issue

Eminent domain should secure the property rights actually necessary for an authorized public purpose—not create permanent landholdings, transferable corporate assets, or vacant property banks.

We call for legislation establishing a Perpetual Public-Purpose Land Lease Alternative with strict ownership, transfer, reversion, and anti-dormancy protections.

CORPORATIONS: LEASE THE LAND, DON'T TAKE THE TITLE

When a corporation or other private entity is granted or permitted to exercise eminent-domain authority, it should be required to obtain a perpetual land lease limited to the authorized use, rather than permanent ownership, whenever that use can reasonably be accomplished through a leasehold interest.

The property owner retains title.

The corporation receives only the land-use rights necessary for the authorized project.

The lease continues while the authorized use continues. When that use ends, the lease terminates and possession reverts to the property owner.

GOVERNMENT: NO CONDEMN-AND-TRANSFER

Government should not be permitted to accomplish indirectly what a private corporation could not accomplish directly.

Property acquired through eminent domain should therefore be subject to a strict No-Transfer Clause.

Land or property interests obtained through compulsory acquisition may not subsequently be sold, assigned, conveyed, donated, subleased, transferred, or otherwise placed under the control of a private corporation, developer, contractor, affiliate, investor, or other private entity merely because government initially acquired it.

Contracting for construction, maintenance, or operation of a legitimate public project should not, by itself, give the contractor ownership or an independently transferable property interest in the condemned land.

Government cannot serve as the middleman for a prohibited private acquisition.

NO-TRANSFER CLAUSE

Any property interest obtained through eminent-domain authority must remain tied to the specific legally authorized purpose for which compulsory acquisition was approved.

Neither government nor a corporate holder may convert that interest into a freely transferable private asset.

Any prohibited transfer should trigger termination of the acquired property interest and the applicable statutory reversion process.

AUTOMATIC REVERSION

If the authorized use is:

abandoned, discontinued, materially changed, transferred contrary to law, or permanently terminated,

the special land-use interest should terminate and the property rights obtained through eminent-domain authority should revert to the original owner or lawful successor, subject to procedures established by law.

No authorized use means no continuing extraordinary property right.

DORMANT LAND PENALTY

Government and corporations should not be permitted to invoke eminent-domain authority and then warehouse the property indefinitely.

Legislation should establish a defined Dormancy Period beginning when the property is acquired or possession is obtained.

If substantial progress toward the authorized use does not occur within the statutory period, escalating consequences should apply.

Those consequences should include:

Public notice and mandatory status reporting.

Financial penalties for unjustified dormancy.

Additional compensation to the displaced or affected property owner where authorized by law.

Mandatory review of whether continued possession remains necessary.

A statutory right to seek reversion when the authorized project has effectively been abandoned.

Extensions should require documented justification rather than automatically restarting the clock.

Government or a corporation should not be able to avoid the dormancy rule through nominal activity designed merely to make unused property appear active.

ANTI-ABANDONMENT CLAUSE

Property obtained using eminent-domain authority must be actively devoted to its authorized purpose and reasonably maintained.

No unnecessary vacant lots.

No indefinite fenced-off parcels.

No speculative land banking under the protection of eminent-domain authority.

No taking property today because somebody might eventually find a use for it tomorrow.

WASTE, CLEANUP & RESTORATION

The entity using the property remains responsible for waste removal, contamination, environmental remediation, maintenance, and restoration resulting from its occupancy or project.

Abandoning a project does not abandon these responsibilities.

FAIR COMPENSATION

A land-lease system cannot become a mechanism for obtaining private property below fair value.

Owners must receive legally adequate compensation for the property interest actually taken or used, with transparent terms governing payment, duration, permitted use, restoration, and termination.

THE STANDARD SHOULD BE NECESSITY

Before permanent ownership is acquired through eminent domain, the acquiring entity should have to establish why the public purpose cannot reasonably be accomplished through a more limited property interest.

If access is all that is necessary, acquire access.

If an easement is sufficient, use an easement.

If a perpetual public-purpose lease is sufficient, lease the land.

Permanent ownership should not exceed the demonstrated necessity.

OUR PROPOSAL

LEASE — DON'T SEIZE UNNECESSARY OWNERSHIP.

USE — DON'T WAREHOUSE.

MAINTAIN — DON'T ABANDON.

NO TRANSFER — DON'T TURN PUBLIC POWER INTO A PRIVATE LAND PIPELINE.

REVERT — WHEN THE AUTHORIZED PURPOSE ENDS, THE EXTRAORDINARY PROPERTY RIGHT ENDS WITH IT.

We call on lawmakers to establish these protections for future exercises of eminent-domain authority.

Public projects can move forward without treating permanent private dispossession as the automatic solution.

Our Land. Our Communities. Our Future.
