Subject: Urgent Application for Interim Release of Former Philippine President Rodrigo Roa Duterte
Your Honors,
I respectfully submit this appeal for the interim release of former Philippine President Rodrigo Roa Duterte (PRRD), who is currently in ICC custody. As an 80-year-old man in fragile health, President Duterte’s continued detention poses significant humanitarian concerns that warrant urgent consideration under Article 59 of the Rome Statute and established principles of international human rights.
Legal and Humanitarian Grounds for Interim Release
1. Severe Health Deterioration
President Duterte’s advanced age and medical condition require immediate and specialized care, which is difficult to provide under detention. Denying him adequate medical attention would constitute inhumane treatment and violate his fundamental rights.
2. No Risk of Flight
As a former head of state who has demonstrated commitment to legal processes, President Duterte poses no flight risk. He has deep roots in the Philippines, where his family and supporters reside, and he has no intention of evading justice.
3. No Threat to Witnesses or Obstruction of Justice
President Duterte’s current condition prevents him from influencing or threatening any witnesses. His interim release would not hinder ongoing investigations or judicial proceedings.
4. Commitment to ICC Proceedings
President Duterte has repeatedly expressed his willingness to face due process and respond to allegations through legal channels. His release will not interfere with the ICC’s ability to conduct a fair trial.
5. Willingness of the Philippines to Ensure Compliance
The Philippine government and relevant legal authorities may be willing to comply with ICC conditions, including:
• House arrest or medical supervision under state custody.
• Regular reporting to designated ICC or UN representatives.
• Travel restrictions to prevent unauthorized departure.
Request for Urgent Consideration
Given the humanitarian nature of this request, I respectfully urge the Honorable Judges of the ICC to approve President Duterte’s interim release and allow him to return to the Philippines before his birthday March 28 under legal conditions. This will ensure his right to proper medical care, uphold human dignity, and demonstrate the ICC’s commitment to justice with compassion.
