

“Honestly I hate I was involved in a man losing his life but I was at my house, and with my family ( my Grandmother, Grandfather and my 10 yr. old sister) when I was approached by him with the gun that was used in the incident.
When being interrogated the Officers tried to get me to say others were involved and was there during or shortly after the incident, I denied anybody being at my house due to I didn’t want trouble for nobody else.”
Trial Attorney Ms. Kimberly Johnson requested a fast and speedy trial asking for both the Murder trial and Possession of a Firearm by felon be tried together due to the incident, arrest warrant and time frame in which it occurred. She told them she didn’t think it would be fair for Armstrong because it gives the State two bites of the apple if Armstrong was acquitted that day. Google: Byron Armstrong acquitted of a Firearm (Perry County Mississippi) June 09 2016 Armstrong was acquitted of the fire-arm charge and Robert Bob Helfrich stated that day Armstrong was still to be held for the Murder trial. During a Pretrial hearing on December 06 2016 another Judge by the name of Jon Mark Weathers asked District Attorney Zachuary Vaughn was the gun in the upcoming trial the same one that Armstrong was acquitted of, Zachuary Vaughn said it was a different gun and they were totally unrelated. By this lie being told it’s Obstruction of Justice by his acts of Prosecutorial Misconduct Armstrongs rights to a fair trial 14th Amendment (Due Process) 5th Amendment (Double Jeopardy were violated)
By Armstrong’s not being able to pay his Attorney to The Indigent of Appeals of Mississippi filed the Appeal after trial. Appointed Lawyer Erin Briggs filed no arguable issues and the State Affirmed Armstrong’s Conviction. Armstrong later filed a Post Conviction Petition (Pro-Se) and it was denied also.
The goal of this Petition:
Ask the State to correct their errors of upholding exculpatory evidence with threatening text messages from the victim as well as not allowing the Toxicology report to show that the victim was all different types of drugs to show the manner of his conduct in which could’ve lead to this happening.
