As landlords, we are required to undergo rigorous checks and comply with numerous regulations, including the fit and proper persons test mandated by local authorities. This is in addition to navigating complex legislation such as the Housing Act 2004 and the implications of Section 24 of the Finance Act 2015. We are held accountable for maintaining our properties and ensuring they are safe and habitable for our tenants. However, there is a growing concern that tenants are not held to the same standards of accountability.
As it stands, the housing system is one-sided. Universal Credit should be abolished, as it is one of the reasons why landlords are selling up, alongside the burdensome regulations, taxes, and legislation. These factors have made it increasingly difficult for landlords to sustain their properties and businesses.
We propose the introduction of a tenant licensing system, akin to the landlord licensing system. This would ensure that tenants are also vetted and held responsible for their actions, particularly regarding the upkeep of the property and the well-being of their children.
From my 26 years of experience as a landlord, I have observed that while tenants are aware of their rights under the Housing Act 1988, many lack a comprehensive understanding of these rights and their corresponding responsibilities. For instance, when advised to ventilate the property to prevent dampness, some tenants mistakenly believe they have the right to ignore such advice, potentially leading to property damage.
Letting agents confirm that tenants are the cause of damp, mould, and condensation. The government has been too lenient in this regard. By implementing a tenant licensing system, we can foster a more balanced and fair rental market where both landlords and tenants are equally accountable. This will not only protect the interests of landlords but also ensure that tenants are better informed and responsible.
