The Issue
Request for Special Meeting to Address Concerns Before the Annual Meeting for 2025
UNDER ARTICLE III - GOVERNING BODY of the Constitution and Bylaws that govern Sherwood Valley Rancheria, Mendocino County, California, aka Sherwood Valley Rancheria Band of Pomo Indians, Titled Section 3. The general meeting of the governing body will be held annually on the second Saturday of January. Special meetings may be called by the Chairman of the Tribal Council, or by written petition of not less than thirty percent (30%) of the general council membership. Twenty percent (20%) of the general council membership shall constitute a quorum, and no business shall be conducted in the absence of a quorum. Members will be notified at least seven (7) days in advance of all special general council meetings.
The purpose of this special meeting is to address the following concerns:
- Seating of the March 9, 2024 elected Tribal Council per the Constitution and Bylaws, including the Election Ordinance (precedence set for over 50 years).
- BIA has offered to fund a third party election services and mediation.
- Suspend the Tribal Chairman for continuing to violate the Constitution and Bylaws, and Tribal Ordinances, including disregarding their duties and obligations to the whole Tribe, indefinitely or until 2025 election.
Chairman refuses to attend seated March 9, 2024 elected Tribal Council meetings.
- Chairman called a Special General Membership meeting for the purpose of a petition to the March 9, 2024 election after the 30 days past to call this meeting per the Constitution and Bylaws, and Election Ordinance.
- Chairman barring general council members from voting.
- Chairman violating confidentiality.
- Chairman falsifying quorum.
- Chairman refuses to acknowledge General Membership’s motion and second of running the June 23, 2024 meeting on their own and ends the meeting without any business being conducted.
- Disband Enrollment and Election Committees for five (5) years.
- Enrollment Committee to be disbanded due to their illegal actions against the General Council Membership’s vote at the January 2024 General Membership meeting to not audit the membership’s enrollment files, including dis-enrolling members without due process.
- Election Committee to be disbanded due to their lack of knowledge of the Constitution and Bylaws, and Election Ordinance.
- All illegally seated Tribal Council members elected from the floor at the April 2024 Special Membership meeting, which did not meet quorum, are to return laptops and phones to the Tribal Administration Office immediately.
- Remove illegally contracted attorney Gregory Narvaez with Peebles Kidder and ensure the Tribe is not financially responsible.
Attorney was voted in by the May 2024 Special General Membership meeting which did not have a quorum. - Moving forward, use a third party election services.
We need your vote to achieve the 30% of the general council membership to call this special meeting so we can unite our Tribe.
Proposed date of Special Meeting, Sunday July 7th or July 14th. We would like for you to be there in person, however your attendance is also welcomed via Zoom.
