Reprimand Judge Yvonne Colodny of Miami for Freeing Puppy Killer - NO Votes For Her!

Judge Yvonne Colodny is with the Eleventh Judicial Circuit Court, Criminal Division in Miami, Florida. As a judge presiding on the case of The State of Florida Vs. Mathew Stuart Milewski, (State Case # 13-2012-CF-001127-001) Colodny has proven to be unethical and wrong in her judgment of both handling and sentencing the case of notorious Miami animal killer Mathew Stuart Milewski (aka Mathew Konrad) by banning TWO important pieces of evidence and then offering a sentence much too lenient. This caused public outrage and many are still rightfully angry over her final decision. Colodny does not deserve our votes for Florida's next election on Circuit Court judges.

In November 2011, Milewski tortured and killed a small beagle puppy named 'Molly'. There were audible witnesses. He admitted to Miami police to the killing as noted in the police report. This was aggravated animal cruelty-- a 3rd Class Degree Felony. This case lasted over 5 years due to Colodny banning key evidences needed, creating a long appeal.
REASON: Colodny allowed the most important evidence to be suppressed; the necropsy results and favored the defendant's ownership rights too much. Milewski lost his ownership and privacy rights because he consciously chose 'group cremation' instead of 'private cremation' for his pet's remains as ruled by FL Third District Court of Appeals and FL Supreme Court. Milewski asked his veterinarian Dr. Heidi Foster of Miami to immediately cremate Molly's remains as it was the evidence. How could judge Colodny not see this?
On February 10Th, 2017, Judge Colodny sentenced Mathew Milewski with NO jail time and offered him only a ONE year probation via a Plea Deal and to pay a small fee of only $1,000 to ASPCA. Milewski was originally facing up to 5 years of prison and/or up to $5,000 in fines. THIS IS NOT JUSTICE. Prosecution requested 60 days custody with two years probation but Colodny immediately agreed to the LESSER sentence request of only one year probation with a donation of $1,000 to the ASPCA. Judges along with prosecution's help go by a "Criminal Punishment Code Score Sheet" which determines the defendant's punishment, however, Milewski only received a paltry 16 points. Additionally, the court docket for this case which included the motion to suppress the necropsy results (Item 156) and that is was granted (Item 173), there is no mention of the motion of veterinarian Dr. Foster's testimony/statement to be suppressed and/or granted even though this is what happened. The dog was resuscitated by her. Third District Court of Appeals ruled that Dr. Foster's testimony/statement should NOT be suppressed.
Judge Colodny Allowed:
1) Suppression of the animal necropsy results from experienced Miami Pathologist***--this was KEY EVIDENCE NEEDED. (See 3DCA doc)
2) Suppression of testimony/statement of Miami veterinarian Dr. Foster who resuscitated Molly and advised Milewski the difference between 'Private' and 'Group Cremations'. KEY EVIDENCE.
3) Ruled too much in favor of Milewski's ownership rights over the dog's body even though he previously lost his rights when he chose "Group Cremation". (Loss of privacy rights ruled by 3DCA and FL Supreme Court-according to Florida law).
4) Did not offer Milewski a ban on owning any pets.
5) Gave defendant a much too lenient sentencing.
This kind of decision making is completely unethical and does not fit the crime! Conduct unbecoming for a judge. If Colodny had not banned the two pieces of evidence, this case would NOT have lasted over 5 years!
Third District Court of Appeals and Florida Supreme Court ruled that both the pathologist's necropsy report results and veterinarian Foster's testimony/statement should be added to this case. Here's proof: (Shortcut: Read end of page 7, all of page 8.
Additionally, Milewski had a shock collar on Molly. Who puts a shock collar on a 4 month old puppy? Did Colodny actually READ the horrible abuse done to this puppy? WHAT IT CAME DOWN TO: Milewski played his 'property card' heavily and Judge Colodny bought into his wishes. Judges must be impartial.

Judge Coldony's insane decision to put a monster back on the streets is beyond comprehension. Milewski is a danger to society. Additionally, the court received countless letters from the public demanding Colodny to jail Milewski along with a petition by T. Scott Arstein that garnered over 33,000 signatures asking the same. Colodny is clearly not fit to make ethical decisions. What if Molly were a child? It is understood that law enforcement obtained the evidence by taking the pup's body BUT, this action was found to be in the right according to THE THIRD DISTRICT COURT OF APPEALS! (see page 8). It was determined by the 3DCA that Miami Police did nothing wrong. Milewski LOST his rights as owner when he chose "group cremation" for Molly.
CONCLUSION: ALL WHO HAVE SIGNED REQUEST THAT MIAMI JUDGE YVONNE COLODNY IS FORCED OFF THE BENCH. WE ARE SICK AND TIRED OF JUDGES LETTING DOMESTIC ANIMAL KILLERS GO FREE WITH NO JAIL! THIS WAS A SERIOUS FELONY THAT COULD LEAD TO FUTURE CRIMES. THE 3DCA'S AND SUPREME COURT'S RULINGS PROVED COLODNY REALLY DOESN'T KNOW THE STATE LAWS. BY BANNING THE EVIDENCE SHE PROLONGED THIS CASE TO GO OVER 5 YEARS AND ALLOWED A DANGEROUS PERSON TO WALK.
Super weak sentences on domestic animal killers should NEVER be accepted in ANY judicial court system. Florida has a very high rate of animal cruelty cases. As for Judge Colodny, she does not deserve any future votes.
