Dear friends and supporters (Português no fim deste comunicado) We are in the final stretch of this huge fight, which has lasted for eight years in the Algarve. On April 6 this year, ASMAA lodged their first case in the Administrative and Fiscal Loulé High Court (Loulé TAF) against the Portuguese government. In addition, we are in the process of lodging our second legal action, which will challenge the decision by APA (Portuguese Environment Agency) to allow ENI to proceed without an EIA (Environmental Impact Assessment) – currently we are waiting for some documentation that we have requested from government bodies before finally lodging. Concurrently, we are also in the process of finalizing all the documentation required to submit a third legal action, which will be lodged in court at the appropriate time. But with all these legal actions running, we do need your support to cover the costs of all the legal proceedings currently running. We are at a space in time, where all types of disinformation is running wild, driven by many interests and using a wide selection of PR, communication tools and bodies. As a result, we decided to highlight certain key factors that we believe are important for you to know: Although there is a call (driven by certain interest groups) to demand that the government forces an EIA prior to any drilling by ENI, ASMAA will not be demanding that at all. Why not? In our opinion, "DEMANDING" an EIA is in fact counter-productive. Such a demand could in fact strengthen the government’s hand, by giving the government the necessary grounds to legitimise their drive for oil and gas exploration along the Costa Vicentina off Aljezur, as of September 15 this year, in spite of massive public opposition. This action would only serve to give carte blanche to the government to continue on the same path: To authorize offshore drilling throughout Portugal. Not only in the Algarve. I’m sure you will all agree, that this is not the right solution, nor what we all want. It has become quite clear that “the solution” should no longer be focused on manifestations, letters, petitions, etc., as all of that has already been done before. Why do we say so? It is very obvious to those who are aware or want to see, that the Portuguese Government does not take into account these types of protests or opposition actions. This leaves us with the only viable option; which is to challenge in a court of law the whole process of “sea and land appropriation” of Portuguese “public” assets by corporate and private interests driven solely by money and power. The bottom line is: if we want to have a chance to succeed, We can ONLY do that in a Court of law. Starting by challenging the validity of the law that enabled all current contracts for oil and gas prospecting, research, development and production to be awarded and signed. That is precisely what ASMAA is doing. But deciding on this legal route, it also means that our objectives will not be reached with one simple legal action alone. The path chosen by ASMAA, means that a series of legal processes will be required (based on the merit of our legal cases) if we want our objectives to be achieved – meaning having a greater chance of success. We are talking about three legal actions in which ASMAA is already directly involved. Although neither we, nor anyone else, can predict or guarantee any legal outcome in Portugal, due to many factors outside our control. We know that our cases are solid, and we strongly believe that we have a good chance for a successful outcome, based on its merits. But only time will tell. In spite of all the frequent calls for the cancellation of the contracts, the reality is that cancelling the contracts will not have the desired effect. Even if such a call is heard and the contract is cancelled, there is no political will to prevent new contracts from being signed in the future. The government is already promoting new tenders for offshore and onshore concessions to be awarded after next year elections. We have been receiving information from reputable sources, that the government is busy “selling the idea” to potential clients in the international market arena. All the talk about “new oil exploration contracts” being suspended until after the elections is just an attempt to pacify the masses, and nothing more than political campaign positioning. The strategy that ASMAA is following is not cheap, easy, or a quick process. Instead it’s complex, expensive and challenging. Invoices arrive every week, which has to be paid. The man-hours required to do all the necessary work, are unprecedented. Our team no longer knows what it's like to have a normal family life or even a leisure time in the past six months, and we do not see it changing in the next 3-months either. But our challenges do not stop at the legal processes, we have a public duty to deal with the massive and formidable wall of disinformation that is currently doing the rounds, and is without a doubt supported by large sums of money. The government and industry machines are in full swing, and its imperative that the people are informed as soon as possible about the REAL FACTS. In an endeavour to inform the general public, ASMAA will be running two very active campaigns in July and August - one on the affected beaches and another in the affected council areas (Lagos, Vila do Bispo, Aljezur and Milfontes) - "Banners on the Beach" and "Banners on the Squares". We will provide more information soon about them. As you have read, we are facing some major challenges, and funding is one of them. Neste momento, com uma ação a decorrer no TAF de Loulé, nós, ASMAA, aguardamos apenas os documentos requisitados pela nossa associação para ultimar a contestação da decisão da APA (Agência Portuguesa do Ambiente) em tribunal. É a nossa segunda acção. Ao mesmo tempo, estamos também a ultimar uma terceira ação, que irá ser submetida em tribunal no momento certo. Mas precisamos do vosso apoio para cobrir os custos dos processos jurídicos que estão a decorrer. Num momento em que as manobras de desinformação se propagam por todos os lados e pelos mais variados meios, vimos clarificar alguns pontos fulcrais: -- A ASMAA não vai contestar o facto de a APA não ter declarado a necessidade de uma Avaliação de Impacto Ambiental (AIA) por parte da ENI para furar na bacia do Alentejo, em setembro. Porquê? Porque, na nossa opinião, o simples facto de “PEDIR” (com base na sua obrigatoriedade), uma AIA, irá proporcionar ao governo o argumento decisivo para legitimar a decisão previamente tomada, a de avançar com a exploração de petróleo junto à Costa Vicentina ao largo de Aljezur, a partir de 15 setembro deste ano. Essa acção só serviria para conferir carta branca ao governo para continuar no mesmo caminho: autorizar furos por Portugal inteiro. Não só no Algarve. Portanto, a solução não é essa. Por outro lado, a solução já não passa também por incidir o foco em manifestações, cartas, abaixo-assinados e tudo o resto, que, aliás, já foi feito em devido tempo. Porquê? Porque é muito óbvio para quem quer, ou consegue ver, que o Governo Português não toma em consideração este tipo de protestos. De modo que o único caminho que nos resta, é contestar todo o processo de alienação indevida do território e do mar português. Em sede própria – ou seja, em tribunal. Começando por contestar a validade da lei de base para os contratos de prospeção, pesquisa, desenvolvimento e produção de petróleo. É isso que a ASMAA está a fazer. Mas este caminho não se constitui numa simples ação. Este caminho implica o desencadear de uma série de processos jurídicos que, necessária e obrigatoriamente vão ter de ser concretizados, se quisermos ter alguma probabilidade de sucesso. Estamos a falar de três ações em que a ASMAA já está diretamente envolvida. Apesar de não termos todas as garantias de que vamos ganhar – em Portugal. Porém, e face a toda a informação que recolhemos, esta é a única possibilidade para travar este ataque ao Algarve, e, ao País no seu todo. Sem provarmos a ilegalidade da lei, cancelando-a, o cancelamento dos contratos não vale nada. Cancelam-se contratos hoje e assinam-se novos contratos amanhã. Aliás o governo já anda a promover mais concessões para depois das eleições ... temos estado a receber abundante documentação em inglês que, em nome do governo de Portugal, está a ser distribuída pelos interessados, nos mercados internacionais. A estratégica que a ASMAA está a seguir, não é um processo barato, nem um processo fácil, nem um processo rápido. As faturas chegam-nos todas as semanas. E o tempo necessário para desenvolvermos todo este trabalho, contabiliza-se em dias a fio e horas sem fim. A nossa equipa já não sabe o que é ter uma vida normal de família ou até de lazer, nos últimos seis meses.
