Ours and ACLU's appeal against the Oversized Vehicle Ordinance has succeeded!

Ok, ok, but what does this really mean?

It means that the Coastal Commission has taken control of the permit process for OVO in the Coastal Zone and thus the OVO is unenforceable on Delaware Ave, Shaffer Rd, or Natural Bridges unless the Coastal Commission decides that they are allowed to get a permit. Given the laundry list of issues with OVO, it is highly unlikely that the city will get a permit or be willing to make the necessary changes to get one.

In 2016, when the city pitched a previous version of the OVO, someone appealed it to the Coastal Commission, the Commissioners found a substantial issue, and the city gave up in its pursuit in implementing the ordinance entirely, only revisiting the idea and building public support for a revised version several years later.

We are hopeful that the city will give up on its misguided mission to criminalize poverty, but are prepared to fight back if they do not. If a Coastal Commission "de novo" hearing does happen, it will be anywhere from 3-9 months from now. We will keep you all informed. Stay tuned!

Until then, let's celebrate this monuments victory for the rights of people living in their vehicle. There is much more to be done.
