Repeal Somerset's ATV ordinance
Repeal Somerset's ATV ordinance
The Issue
Repeal Somerset, Kentucky’s October 26, 2026 ATV Ordinance
We, the undersigned, call upon the Somerset City Council to repeal the ordinance passed on October 26, 2026, restricting the recreational use of ATVs, four-wheelers, dirt bikes, and similar vehicles on private property.
Property owners should be able to enjoy lawful recreational activities on their own land without being subjected to vague and subjective restrictions.
This ordinance raises several serious concerns:
Vague language: Terms such as “continuous use” and “inappropriately sized lots” leave residents uncertain about what activities are prohibited.
Property rights: The ordinance restricts recreational activities on privately owned land, even when those activities may be conducted responsibly.
Public participation: Residents requested opportunities to address the council before the ordinance was adopted but were not given those opportunities.
Insufficient consideration of affected residents: Council members involved in advancing the ordinance acknowledged that they had not spoken directly with the property owners whose activities prompted the complaints.
We recognize that residents have legitimate concerns about excessive noise and disturbances. However, those concerns do not justify an ordinance with unclear restrictions that may affect property owners throughout Somerset.
We respectfully demand that the Somerset City Council repeal this ordinance in its entirety.
We also request that residents be given a meaningful opportunity to address the council before any future legislation restricting recreational activities on private property is considered.
Sign this petition to ask Somerset’s elected representatives to repeal the ordinance and hear from the residents affected by their decisions.
