# Repeal Pennsylvania’s Vape Ban — Protect Adult Choice and Small Businesses
The Issue
To Governor Josh Shapiro, Attorney General Dave Sunday, and the Pennsylvania General Assembly:
I’m a Pennsylvania resident concerned about the impact of Act 57 of 2025 on adult consumers, independent vape shops, and small businesses throughout our state.
Beginning October 19, 2026, Pennsylvania can begin enforcing restrictions preventing retailers from selling nicotine vaping products that are not included in the state’s approved Electronic Nicotine Delivery System (ENDS) directory.
These restrictions affect bottled e-liquids, disposable vapes, cartridges, and other covered vaping products.
I am calling for the complete repeal of the ENDS directory requirements and associated sales restrictions established under Act 57 of 2025.
Why this matters
Adults who have legally purchased vaping products for years now face losing access to their preferred brands, flavors, and equipment.
Independent vape shops face an uncertain future. Businesses that have built their livelihoods serving adult customers could experience significant inventory losses, reduced sales, and the possibility of closing their doors.
Meanwhile, consumers may face additional expenses as they search for alternatives or attempt to replace products they can no longer purchase locally.
The limited approved directory also raises concerns about competition and whether smaller manufacturers have a fair opportunity to remain in the Pennsylvania market.
We support protecting minors
We recognize that nicotine is addictive and that preventing youth access is essential.
Pennsylvania should continue enforcing the legal purchasing age of 21, proper identification requirements, and appropriate consumer-safety standards.
However, we believe those protections can coexist with greater product choice for adults and fair competition among businesses.
What we are requesting
Our primary request is the complete repeal of Pennsylvania’s new ENDS directory restrictions under Act 57 of 2025.
We ask the Pennsylvania General Assembly to introduce and pass legislation removing these requirements while maintaining appropriate protections against underage sales and unsafe products.
If repeal cannot be accomplished promptly, we request immediate action on pending applications.
We ask Attorney General Dave Sunday and the Pennsylvania Office of Attorney General to:
1. Expedite the review of pending manufacturer certifications wherever legally permissible.
2. Provide greater transparency regarding pending applications, required documentation, and review timelines.
3. Process eligible applications as efficiently as possible so compliant products can be added to the approved directory.
4. Ensure smaller manufacturers receive clear guidance and a fair opportunity to meet the state’s requirements.
Pennsylvania businesses and consumers deserve to be heard
This issue extends beyond vaping. It raises questions about adult consumer choice, small-business survival, market competition, and the appropriate balance between public health and government regulation.
We are asking Pennsylvania’s elected officials to hear these concerns and reconsider the restrictions.
Repeal Pennsylvania’s ENDS directory requirements. Until then, ensure pending applications receive timely, transparent, and fair review.
Please sign and share this petition to help bring these concerns to the attention of Pennsylvania lawmakers.
