Recent Developments:
March 26, 2025: The Florida House of Representatives passed HB 6017 with a 104-6 vote, aiming to repeal the “Free Kill” provision, which currently prohibits adult children over 25 and parents of adult children from recovering certain damages in medical negligence suits.
March 27, 2025: The Senate Rules Committee favorably reported SB 734, moving it to the Senate floor for consideration.
If SB 734 passes in the Senate and is signed by the governor, the repeal of the “Free Kill” law would take effect on July 1, 2025.

I am writing to urge you to support HB 6017 / SB 734, which would repeal Florida’s outdated and unjust wrongful death statute—commonly referred to as the “Free Kill” law (Fla. Stat. §768.21(8)).
Under this current law, if a person is over the age of 25, unmarried, and has no minor children, their family has no legal right to file a wrongful death lawsuit—even in cases of clear and devastating medical negligence.
This means that families cannot hold negligent providers accountable. Hospitals and doctors can commit fatal errors without consequence—simply because of a patient’s age or marital status. Florida is the only state in the country with such a cruel and discriminatory restriction.
Every life should count equally under the law. Every family deserves the right to seek justice when a loved one dies due to preventable medical errors.
I respectfully ask you to vote YES on HB 6017 / SB 734 and help bring long-overdue accountability, compassion, and fairness to Florida’s wrongful death laws.
