REPEAL ERISA. Save the American Consumer Billions annually.

The Issue

I am pushing for the repeal of the Employee Retirement Income Security Act of 1974 (ERISA). While this federal law was enacted with the worthy goal of protecting employee benefits, its decades-long implementation has revealed significant and detrimental unintended consequences that now demand its reconsideration.

Specifically, ERISA has inadvertently created a shield behind which insurance companies and Pharmacy Benefit Managers (PBMs) operate with a concerning lack of transparency and accountability. These entities, entrusted with managing healthcare benefits for millions of Americans, have leveraged ERISA's complex framework to obscure their practices, leading to inflated costs and reduced access to affordable care.

The current system allows for the accumulation of enormous profits by these intermediaries, often at the direct expense of American consumers and employers. The lack of state-level oversight, preempted by ERISA, has hindered efforts to implement crucial cost-control measures and ensure fair practices within the healthcare and pharmaceutical industries.

Repealing ERISA would pave the way for states to enact stronger consumer protections, increase transparency in healthcare pricing and benefit management, and ultimately foster a more equitable and affordable healthcare system for all Americans.
