We, the undersigned, petition for the removal of Judge Elaine Carbuccia due to her consistent failure to uphold Florida Statutes and adhere to the Florida Family Law Rules of Civil Procedure, as well as the Florida Rules of Civil Procedure. Many families, including our own, have experienced rulings from Judge Carbuccia that appear biased, alarmingly negligent, and devastatingly harmful to both parents and children involved. Her decisions have led to forced separations of children from their parents, inflicted severe emotional and mental anguish, have gravely impacted our health, and resulted in undue financial hardship, all of which compromise our fundamental rights to fair judicial treatment.

Judge Carbuccia was appointed to the bench merely six years post her graduation from law school, where her only experience was serving as a federal law clerk, lacking essential litigation experience as well as knowledge of proper judicial practices. This deficiency is now evident in her rulings, which often extend beyond the issues at hand, suggesting an overreach of authority and disregard for procedural fairness. Such rulings, marked by undue influence, contravene the principles of an impartial judiciary and violate the foundational standards that safeguard equitable treatment in court.

We recognize and respect the judicial office; however, when a judge demonstrates a pattern of unreasoned bias, we must take action. The judiciary must be a model of fairness, unwavering respect for constitutional rights, and strict compliance with legal boundaries. Judge Carbuccia's decisions, marked by perceived bias and procedural lapses, undermine public trust in the judicial system and inflict harm that extends beyond the courtroom.

For these reasons, we call for the removal of Judge Elaine Carbuccia from the 17th Judicial Circuit Court of Florida. We stand united in our demand for judicial integrity, impartiality, and accountability.
