To that end, I've hired a Sentencing Guidelines expert to review the Pre-Sentencing Report and sentencing of Dr. York's case. She said it was one of the most complicated she had ever seen, which wasn't a surprise to me. Although, Dr. York did go to trial, he technically would not receive any reductions under acceptance of responsibility. However, in mitigation, the point should be made that he did accept responsibility from the onset and plead guilty pursuant to the plea agreement he made to have the alleged female co-conspirators released. Per the initial plea agreement, he was to receive reductions for acceptance of responsibility. But for the rejection of the plea deal by the Court, he would have received credit for acceptance of responsibility and probably would have served only 15 years. Had the plea been accepted by the Court, his term of incarceration would now be over. Please help me get the 4th Clemency Package to the White House to incorporate all the expert provided!!
