It has been erroneously stated that President Obama does not have the power to pardon or commute the sentence of Dr. York, however, the Constitution says otherwise. Article II, Section 2, of the Constitution states that the President “shall have the power to pardon offenses against the United States except in cases of impeachment.” The Supreme Court has, throughout history, interpreted the word “pardon” to include pardons, conditional pardons, commutations, conditional commutations, remissions, and group pardons (or amnesties).
