The White-Slave Traffic Act, better known as the Mann Act, is a United States federal law. In practice, its ambiguous language about "immorality" has resulted in it being used to criminalize even consensual sexual behavior between adults. The world champion heavyweight boxer Jack Johnson was known to be intimate with white women. The year the Mann Act of 1912 was enacted, he was prosecuted, and later convicted, for "transporting women across state lines for immoral purposes" as a result of his relationship with a white woman named Belle Schreiber. Chuck Berry and Charlie Chaplin were other superstars who were charged and convicted of Mann Act violations, which does not require proof of force, fraud, or coercion, but only proof that transportation with the intent of a sexual encounter occurred, which is an extremely low bar for the prosecutors to prove. The RICO statute was originally enacted to eliminate “the infiltration of organized crime and racketeering into legitimate organizations operating in interstate commerce.” In practice, and as wrong as this may be from a litigious perspective because whatever happened to guilty beyond a reasonable doubt, this statute allowed prosecutors to charge members of organized crime who had not even physically committed a crime, but had either ordered it or had some part in arranging the circumstances of the alleged offense. The RICO statute also allowed the prosecution to seize assets gained through these alleged racketeering offense during the litigation, making it difficult for defendants to pay attorneys because their funds were seized and further aiding in the appearance of wrongdoing to the public.
