This petition is intended to be read by District Court Judge Sharon Holbrook of the 17th District of Broomfield County. During the trial the judge was only shown the image that the State painted of Shane Hammond. We hope she will take into consideration the facts presented and who Shane Hammond really is during sentencing. 

The State has falsely accused and convicted Shane Hammond of a crime that he did not commit. This conviction has been detrimental to our community, family, friends and loved ones. Shane Hammond was deemed a threat to society and therefore not granted bail before sentencing. Shane has no prior convictions and has done nothing before or since this accusation that could deem him a threat to society. He has maintained his innocence throughout.   

• During trial the victim did not pick him out in the courtroom. When asked if the man who kidnapped her was in the room, she said no.  He was in the courtroom directly in front of her.  
• None of the four articles of DNA  matched Shane.
• The victim first said she was pushed into a white van (which was what was broadcasted on the news when this first happened), then she said it sounded like a grey car but ended up a grey truck.
• He does not fit the description of an average sized man, not strong, and 30 to 40 years old with no tattoos (he has four tattoos on his arms, very strong and still not 30, etc.)
• The photo line-up according to the expert hired by Shane’s counsel, said that it was beyond an absurd line-up and the top two longest line-ups a victim took to point out the suspect.  This was out of multiple hundreds of line-ups the expert has seen.
• The victim claims she got out of the right passenger door that was proven broken and not able to open from the inside.
• The victim's sister, texted the victim, "You have to walk home alone today."  This text was sent in Polish and the contact changed to 'boyfriend.'  Meanwhile, the parents were both home eagerly waiting for her to get home to “go to dinner??” 
• Several witnesses said they saw nothing, including a woman who was there during the time frame and a man who said he saw her walk past the vehicle.
• There was no license plate captured.  Also, there was proven absolutely no yellow on Shane’s truck like the victim said there was.
• The parents stories were completely different.  Also, the dad was actually asked by the detective to move away because he was leading the daughter’s answers about the incident. 
• No hard evidence proving this happened or that it was Shane.

Throughout the duration of Shane's life, he has not been a threat to society having no prior convictions.  Since being falsely accused of this crime three years ago, he has continued to live like he always has as an honest and intentional man meanwhile maintaining his innocence.  He has done the following since this horrific accusation: 

- Been compliant with law enforcement in order to support them in keeping our community safe. 

- Voluntarily and immediately gave his DNA, cell phone and other items to prove his innocence which came back unmatched.

- Showed up to every court hearing respectfully fighting for his innocence.

- Has been the primary caretaker for his declining grandmother, living with her and providing care around the clock.

- Ran his own painting business.

- Volunteered to paint houses to those who could not afford it. 

- Volunteered in the community, doing yard work, clean-ups and volunteering with the organization of his class reunion. 

- Maintained a healthy and stable relationship. 

Shane Hammond does not belong in prison. He is a family man, a caretaker, a brother, a son, an uncle, and most importantly an innocent and honest man who was taken advantage of by the system.  Those who know Shane Hammond, know that the image painted of him by the State is inaccurate and wrong. Please join us in showing Judge Holbrook that Shane is NOT a threat to society, but rather a loyal and contributing citizen who does not belong in prison!
