Release Rodrigo Morales from ICE detention
The Issue
Rodrigo Morales, 34 years old single-father, has deep and longstanding ties to Upstate New York. Rodrigo has lived here for nearly his entire life, 30 years, residing mostly in Clyde, NY, where he attended grade school, from pre-k through high school graduation. As residents and teachers will affirm, Rodrigo was a high achieving model student reaching high honor roll and a multi-sport athlete breaking school records. Rodrigo established a family, developed many relationships, and kept his livelihood here in the Finger Lakes. His life is firmly rooted in our community.
Most importantly, Rodrigo Morales is a single father to 2 children who depend upon his presence, support, guidance, and care. His continued detention has a significant emotional, financial, and practical impact on his children and family. His release would allow him to return to his family and resume his responsibilities as a parent, partner, provider and member of his community while continuing to comply with all requirements imposed by immigration authorities and the immigration court.
Rodrigo Morales also owns and operates Eleven Lagos Construction LLC, an entrepreneurial business that he has built in the Finger Lakes region. His business provides for his family and contributes to the local economy. His release would allow him to resume his responsibilities and preserve the livelihood that supports his household.
We respectfully ask ICE to consider the totality of these circumstances. Rodrigo Morales has substantial family, residential, professional, and community ties in this area. These connections provide powerful reasons for him to remain in compliance with his immigration proceedings and return to his family and community when released.
Rodrigo Morales does not present a danger to the community, he does not pose a threat to the safety of others, and he is not a criminal. We respectfully ask that his individual circumstances and any applicable immigration history be considered fairly and in their proper context.
Rodrigo Morales also does Not present a flight risk. His children, family, home, business, and lifelong connections are all located in Upstate New York. He has spent his entire life building his family and livelihood here. His release would not mean that he is beyond the reach of immigration authorities; rather, he would be able to remain with his family while complying with any conditions of release, reporting requirements, court dates, check-ins, or other conditions that ICE or the immigration court may impose.
We understand and respect ICE's responsibility to enforce federal immigration law and to make individualized custody determinations. We are not asking ICE to disregard its responsibilities. We are asking that ICE consider the truth and substantial equities presented by Rodrigo Morales's circumstances and determine that detention is not necessary in his individual case.
If released, Rodrigo Morales has a strong support network in this community. His family and community members are prepared to assist him with transportation, court appearances, ICE check-ins, legal appointments, and compliance with any conditions of release.
For these reasons, we respectfully request that ICE give favorable consideration to release on bond, parole, or another appropriate form of discretionary release, and permit Rodrigo Morales to return to his children, family, business, and community while his immigration matter proceeds.
We, the undersigned members of the Upstate New York community, respectfully submit this letter in support of Rodrigo Morales and request that U.S. Immigration and Customs Enforcement exercise its discretion to release him from detention, whether through parole, release on bond where legally available, or another appropriate form of supervised release.
