Refuse The Frankal Investment Trust proposal to build over The Communal Deck
The Issue
Since it was redeveloped, The Empire Building, located at 96 Beach Road, Muizenberg, has become the landmark for the Muizenberg Beachfront. One iconic feature seen from the road and beach is the Communal Deck, a unique selling point by the developer and estate agents to date.
Most of the units in the building face towards inner courtyards and whereas the front facing units are mainly Airbnb and or foreign owned, this cherished spot is open to all who reside in the building, —a safe haven to enjoy the beachfront views and watch the waves in peace. Yet, its existence is under threat, due to a proposal from The Frankal Investment Trust who recently bought a portion of the real right from the developer to the common property.
The Frankal Investment Trust has applied to erect an apartment on this communal space, not only eliminating the community amenity but also destroying the Art Deco cantilevered lip and its architectural charm that has become synonymous with The Empire Building. This actualisation would strip residents of this necessary community space and mar the distinctive aesthetic of The Empire. It is a direct affront to owners by the developer and builder, who championed the deck's accessibility during their sales pitch.
At the November 2024 AGM, the Body Corporate voted in majority against this proposal. This application represents an ill-considered initiative, disregarding the wishes and well-being of the building's residents.
We implore the relevant authorities to review and refuse the Frankal Investment Trust's application. The future of the communal deck—the heart of our community—hangs in the balance. It is crucial that we preserve it for current and future residents who deserve to experience the charm, history, and sense of community it offers.
