Reform Wrongful Death Settlement Processes

The Issue

Petition Request for Legal Reforms in Wrongful Death Settlements
To: The Honorable Members of the Legislative and Judicial Committees

Subject: Petition for Legal Reforms to Ensure Fair Treatment and Transparency in Wrongful Death Settlements

Dear Honorable Members,

I am writing to bring to your attention a grave injustice that has not only deeply affected my family but also highlighted the urgent need for legal reforms in the handling of wrongful death settlements. My experience, following the tragic death of my daughter in a car accident in 2022, has revealed severe flaws in the system that families in similar situations should never have to endure.

During an already devastating time, I was subjected to manipulation, and they treated me with blatant disrespect based on my appearance. These legal professionals, who should have provided support, instead conspired to add additional lawyers to siphon more money from the settlement under the pretext of mistrusting me.

Throughout the settlement process with the trucking company involved in the accident, I initially encountered supportive legal representatives. However, once the settlement was reached, their behavior changed drastically. They colluded to insert another lawyer into the case, thus reducing the settlement amount meant for my grandson, who lost his mother. This egregious act of exploitation has left me feeling betrayed and has shown that stereotypes and biases often guide the actions of those entrusted with justice.

To add to the emotional turmoil, I was misled about my daughter’s condition, initially told that she was still alive in the hospital. Furthermore, despite the vehicle involved being registered in my name, I was not informed about the accident in a timely manner. These actions, or lack thereof, have only compounded my grief and mistrust in the legal system. As my daughter died with no one by her side.

It is clear that families like mine are being unfairly judged and mistreated, with courts and legal professionals often profiting from our pain. This systemic issue demands immediate attention and reform. Therefore, I am calling for the implementation of "Carter’s Law," a legislative reform to ensure:

Fair Treatment and Respect: Legal professionals and court-appointed conservators must treat grieving families with the dignity and respect they deserve, irrespective of their appearance or personal circumstances.
Transparency in Settlements: Clear, transparent processes should be established to prevent unnecessary and exploitative additions of legal representatives in settlement cases.
Support for Families: Mechanisms should be put in place to offer genuine support and guidance to families navigating wrongful death settlements, ensuring their best interests are prioritized.
Accountability for Legal Professionals: Strict penalties for attorneys and conservators who exploit or manipulate grieving families, including suspension and disbarment for severe offenses.
Mandatory Notification Protocols: Immediate and clear communication protocols to notify next of kin about accidents and legal proceedings involving their loved ones.
My family’s ordeal should serve as a catalyst for change. I urge you to consider this petition seriously and take the necessary steps to protect families from further exploitation and mistreatment during their times of greatest need.

Thank you for your attention to this critical matter. I hope that together, we can create a fairer and more compassionate legal system for all.

This petition aims to address and rectify the injustices faced by families in wrongful death cases, ensuring they receive the respect and support they deserve.
