

Reform pension benefits for Indian political representatives
The Issue
An Indian employee with an educational background, contributes diligently to our nation's economy by paying taxes, surcharges, cess, and more, consistently and without exceptions. They face countless challenges, adhering to strict guidelines and conditions associated with regular service employees. Yet, when it comes to our elected representatives , why do we stand apart when it comes to pension benefits?
As directed by the Supreme Court, pensions are intended as a welfare measure, earned after a lengthy service period. In regular service, employees must adhere to stringent criteria, including a defined service duration(minimum 10 years), to qualify for pension benefits. Given these facts, it raises a critical question: why aren't representatives brought under standardized service regulations?
Representatives, by definition, are not holding permanent positions. Unlike regular employment, there are no specific norms to define their service years, making their pension benefits seem unwarranted and unchecked. This discrepancy highlights a systemic issue that demands urgent attention.
A logical and equitable solution would be to integrate representatives under the ambit of proper service regulations. Introducing service norms and conditions similar to those existing for public employees will ensure fairness and consistency across the board. It is high time we introduce electoral reforms that bring transparency and accountability to the pension benefits awarded to legislators.
Addressing this inconsistency can not only bring about fiscal responsibility but also restore public trust in government's management of public funds.
Suggestive measures for consideration of modified system or existing one as one seeks to establish a truly improved system overhauling the past mistakes and loopholes in order to make India a truly democratic one, rather autocratic one as in the name of legislative autocrats , are :-
1). change in the pension immediately.. for top to bottom, merely serving the period should not guarantee pension .. there must be minimum service period .. that should also have a APAR system for legislators. Before election they talk about their agendas and they release manifestos if belongs to a particular party. There should be clearly defined goals and upon successful completion only of tasks/ goals said by them, their period of service should be added as a period for completing the minimum required period otherwise their service is not included at all for pension period .. this step only will improve their performance and also will make them truly responsible for serving the nation ..
2). Another solution is to modification in contesting the elections .. meaning they should not be allowed to contest elections continuously again and again .. they should be made to wait at least 15 years before contesting again.. it will not give them burden of serving the country just for pension instead they will get the proper time to realize what they could do better before serving again.. why 15 years- they will have in front of them at least 3 terms of different leaders.. that is a good thing to understand many things. Secondly, people won’t be feeling monotonous rule or in a way dictatorship if at all one incompetent individual is winning because of any kind of loopholes.. it will not let the trust of people erode in the democracy.. this country needs democracy and to save democracy, there is need to think of solutions to prevent corruption and make a system or even better I would say, a rule based system , where neither citizens nor representatives suffer..
3). Another solution to make them more productive and effective representatives, there should be probation period for them to receive benefits.. this might sound silly yet it is effective because the lower machinery or you can say permanent post holders know their position and work well not all time freshly or newly representative.. they are given training in office procedures yet that is not the sole purpose of being a representative.. I hope that is not taken in bad way.. A person should not refrain from learning that is this solution provides.. as a representative, they might not have all skills to serve their country.. this step will ensure they are trained all round be it their language , behaviour , even moral and ethical values they need for that post.. party politics is not the need of the hour.. it is high time to solve problems not merely party specific issues..
4). the best one - make them as regular employee and giving them one time representation opportunity then like we have in army , ssc opportunity for 10 years later giving them jobs in other places.. the same way one time , only one time representative, then if they wish to receive pension at all, must be given , jobs suitable to their qualifications and various eligibility criteria. It won’t let problems accrued and also , if by chance , experienced leaders feels to serve, they will get the chance to serve through their jobs .. this way things won’t get worse and people won’t have issues with representatives not being efficient..
5). There is provision of pension for employees just once after serving so long.. representatives get many times pension as if they have done so much work of so much people.. it is violating fundamental rights by being discriminatory to all those who work for the nation .. as a violation too, it should be stopped not to give court cases a way for ending it without making unnecessary burden of poor people’s money.. today , it is in the form of petition , what if court cases start around it , that will be more challenging if faced by representatives . As I said, we should reform the democratic system for all both representatives as well as people.. the representatives might not have thought of it to get themselves responsible for such decisions as they were taken in the past yet they are fully aware of the nature of benefits they are getting that itself shows that they can think of nation’s progress too if they have to willingly take such decisions.. there is need to review the pension plan for representatives at the earliest to avoid loss to the county’s wealth as this system was also a colonial legacy of we see it’s historical context as well.. that was devised all know why .. I hope today’s representatives don’t feel that they are here to loot India’s wealth like them..
these are not only solutions .. there might be much more if one comes to think about serving the country and people.. today , India is not seen as democratic , it is always talked like we are talking party issues and leaders.. truly , we need leaders but not those who represent only party.. we need solution providers , those who know how to solve problems and even approach people when they are facing crisis with better solutions and better governance..
Now coming to pension , it is seriously not right to give it like a charity to representatives as forbidden by Supreme Court in its ruling.. still , it is not right that none thought of it till date .. all representatives raise issues about people and country , forget that they are also having issues with their representations.. there is a saying- charity begins at home .. I feel this representation and all laws, including all laws , acts passed for salaries , emoluments and pensions for representatives must be reviewed to make them more effective and accountable to people and country.. hard earned money should not be wasted by corruption..
