The Issue

I, as the creator of this petition, have been intimately involved in an ongoing family court case since October of 2020. It is with great urgency and personal experience that I call for a comprehensive reform of family court systems and child support guidelines.

In my case, I filed for 50/50 custody of my two children, seeking a fair and equal parenting arrangement. However, to my dismay, the child support calculation was heavily based on my overtime earnings at work. Meanwhile, their mother willingly chose to remain unemployed for four years without any repercussions from the court system.

This flawed approach has created an unjust burden on me as a parent. The more overtime I work to offset the inflated child support payments, the higher those payments become. This vicious cycle has left me trapped in a never-ending struggle to provide for my children while being financially drained by an unfair system.

Furthermore, what deeply concerns me is that despite clear evidence of mental and physical abuse inflicted upon my children by their mother's and stepfather's hands, the courts have shown little concern or action towards protecting them from harm. This lack of attention to their well-being raises serious questions about the effectiveness and fairness of our current family court systems.

It is not just my personal story that compels me to take action; it is also supported by alarming statistics that highlight systemic issues within family courts:

1) According to data from the U.S. Census Bureau (2019), only about 17% of custodial parents are fathers who receive child support.
2) A study published in Psychology Today found that false allegations made during custody battles occur in approximately 20% of cases.
3) Research conducted by The Leadership Council on Child Abuse & Interpersonal Violence suggests that up to 58% of abuse allegations made during divorce or custody disputes are valid.

These facts underscore the urgent need for reform within our family court systems and child support guidelines. We cannot allow a flawed system to perpetuate financial hardships, unequal parenting arrangements, and the endangerment of children.

Therefore, I urge lawmakers, policymakers, and relevant authorities to take immediate action to address the following key issues:

1) Review and revise child support guidelines to ensure fairness for both parents based on their actual income rather than relying heavily on overtime or other temporary earnings.
2) Implement stricter regulations regarding unemployment benefits for custodial parents who willingly choose not to work without valid reasons.
3) Establish a more comprehensive evaluation process when allegations of abuse or neglect are raised during custody disputes, ensuring the safety and well-being of children is prioritized above all else.
