Petition to the Members of the Alabama Legislature

Alabama’s criminal justice system should ensure accountability while also recognizing differences in responsibility. Under current Alabama law, individuals convicted under accomplice liability can receive the same sentence as the person who actually committed the killing—even when they did not personally cause the death or intend for a death to occur.

In many cases, this results in life imprisonment or life without the possibility of parole for individuals whose level of participation and intent may be significantly different from that of the principal offender.

Justice should be proportional. The person who directly commits a homicide and the person who may have been involved in a related offense are not always equally responsible. Our sentencing laws should allow courts to recognize those differences.

At the same time, Alabama’s prisons remain severely overcrowded. Sensible sentencing reforms could help reduce excessive long-term incarceration while maintaining accountability and protecting public safety.

We urge the Alabama Legislature to review and reform accomplice liability sentencing laws to:

• Establish separate sentencing guidelines for principal offenders and accomplices.

• Require proof of intent to kill before imposing the most severe penalties such as life without parole.

• Allow judges to consider an individual’s level of participation and intent.

• Provide a pathway for reviewing sentences imposed under broad accomplice liability provisions.

Reforming these laws would promote fairness, strengthen confidence in the justice system, and help address overcrowding in Alabama prisons.

Every person deserves a sentence that reflects their actual role and responsibility.
