The Issue

Experiencing wrongful termination and discrimination is not just a personal injustice; it's a battle against unjust systems that have been in place for far too long. When I faced discrimination and wrongful termination from a global employer, I not only lost my job but also my sense of security and justice. This unfortunate incident exposed the inadequacies of the current compensation caps set for large employers, especially those employing over 5,000 people.

The cap on punitive damages, established in 1991, does not reflect today's economic realities. In a world where inflation and the cost of living have soared, it's crucial that our legal frameworks also evolve. Currently, the outdated cap prevents employees from receiving fair compensation for the wrongdoings of giants in the industry. Companies of such magnitude should be held liable to a much higher standard, at least $3 million in punitive damages, acknowledging the influence and power they wield.

The rationale for this cap adjustment is clearly rooted in the need for fairness and justice. Referring to economic data, inflation has significantly increased since the early '90s, diminishing the real value of compensation caps and thereby undermining the deterrent effect these penalties are supposed to have. Statistics from credible economic reports highlight that maintaining the outdated caps does not equate to fair representation of today's financial dynamics.

Those who have suffered should not feel as though justice is capped due to outdated economic indicators. By aligning compensation caps with modern economic conditions, we can ensure that victims of wrongful termination and discrimination are justly compensated for the emotional and financial turmoil they endure.
