The Issue

Letter to the Fort Lauderdale City Commission Re: Enforcement of the Fort Lauderdale Beach Noise Ordinance Dear Mayor and City Commissioners, As residents of Las Olas Beach Club Condominium, we are writing to express our growing concern regarding the inconsistent enforcement of the City’s noise ordinance along Fort Lauderdale Beach. While we appreciate the City’s efforts to maintain a vibrant beach district, residents continue to experience excessive noise generated by vehicles parked along A1A. In particular, the areas around Cortez Street and Poinsettia Street along the A1A have become a frequent gathering point for parked beach shuttles and other vehicles with amplified sound systems. We have observed beach shuttles remaining parked while passengers participate in karaoke, with individuals singing and shouting lyrics into microphones at extremely high volumes. This activity can continue for extended periods and creates significant noise for nearby residents and businesses. Completely empty Golf Carts often cruise the area with the speakers blaring, often into the early AM hours. We would also respectfully ask the City to clarify whether a permit or other authorization is required for beach shuttles to operate amplified karaoke or similar entertainment while parked along A1A, particularly when passengers are using microphones and amplified sound systems. If a permit is required, we would appreciate clarification regarding how those permits are regulated and enforced. If no permit is required, we would ask the City to clarify what noise restrictions apply to this activity. It has also become increasingly common for automobiles and motorcycles equipped with amplified speaker systems to remain parked along A1A while playing music at extremely high volumes, often for extended periods. The resulting noise significantly impacts the quality of life of nearby residents and guests. Our condominium residents have repeatedly contacted Code Enforcement regarding these incidents. Unfortunately, we have been advised that Code Enforcement lacks the authority to enforce the noise ordinance against vehicles. Instead, responsibility rests with the Fort Lauderdale Police Department. This creates a troubling inconsistency. Commercial establishments operating along A1A are subject to citations and fines when found in violation of the City’s noise ordinance. However, parked vehicles producing similar or even greater levels of noise frequently go unenforced. Residents are left questioning why one source of excessive noise is actively regulated while another is effectively ignored. We respectfully request that the City Commission review this apparent enforcement gap and work with the appropriate departments to ensure that the City’s noise ordinance is applied consistently to all sources of excessive noise, including automobiles, motorcycles with amplified speakers, and beach shuttles operating amplified entertainment. Effective enforcement is essential to protecting the peaceful enjoyment of our homes while preserving Fort Lauderdale Beach as a destination that is welcoming to both residents and visitors. We would welcome the opportunity to discuss this matter further and assist in identifying practical solutions that balance public enjoyment with the rights of residents.
