Reclassify AR-14's, AK-47's and similar rapid-fire weapons as Title II guns.

The Issue

The Gun Control Act of 1968 is a U.S. federal law that regulates the firearms industry and firearms ownership. One of the most significant features of this act was the establishment of two categories of weapons: Title I and Title II.

Title I weapons are standard rifles, handguns, and shotguns. 

Title II weapons are machine guns, short-barreled or “sawed-off” shotguns and rifles, and so-called “destructive devices” (including grenades, mortars, rocket launchers, large projectiles and other heavy ordnance). 

Given these two classifications, it's quite obvious that AK-47's, AR-15's, and other such weapons of mass destruction should fall into the Title II category. Notice that it is legal to own a Title II weapon. No one is taking away anyone's right to own AK-47's or AR-15's.  However, by reclassifying these kinds of weapons as Title II, the procedure for obtaining them becomes much more involved. 

To legally own a Title II weapon, you first have to apply for approval from the federal government. After purchasing the gun, you must fill out an ATF Form 4 application and wait for approval before taking possession of the firearm. The FBI conducts a thorough background check using fingerprints and a photograph required with your application, which could take 9 to 12 months to process. The gun will need to stay in possession of the previous owner until the process is complete.

In addition, you will need to pay a $200 “NFA tax stamp” for each weapon transaction. If approved, you will receive your paperwork in the mail that includes a permit with the listed lawful possessor of the firearm. Only then can you take the Title II weapon home and possess it legally.

Each side gives a little with this reclassification, but neither side gives in. No 2nd Amendment rights are violated. No weapons are banned or outlawed. This petition merely places rapid-fire weapons of mass destruction like AK-47's and AR-15's in their proper category.
