Reclaim 1,200+ sq ft of Imperial Point Property at Boat Ramp from Abutting Homeowner
The Issue
We the members of IPPOA request that the fence be moved back to the property line between 10400 Sovereign Drive and the north side of club property along the boat ramp. This must be done as soon as possible to remove the outstanding liability issue that our community now faces, and to reclaim over 1,200 square feet of Clubhouse property currently being used by the homeowner, Jory Romano.
This problem was first noted in October 2020, after Mr. Romano, bought 10400 Sovereign Drive. Though the property line and club fence has been an outstanding issue for many years, Mr. Romano has stated that he worked out an agreement with a previous IPPOA Board President, Andre Bourgeois, to keep the fence in its current position and allow him to install new plantings on club property, in exchange for the current golf cart pad outside the boat ramp. No board meeting minutes, or recorded votes taken by the Board at that time have been found in the record that would allow Jory to continue to use the land. The Clubhouse and Mr. Romano’s property deeds do not reflect any change of ownership of this property.
This situation was initially raised formally in January 2022, and again in March 2024, without resolution. On two occasions by two separate IPPOA Boards, Mr. Romano has been offered the opportunity by IPPOA attorneys to sign a lease agreement to use the easement without moving the fence for as long as he is the owner. However, Mr. Romano has refused to follow their recommendation. This situation is a significant liability concern should anyone visiting Mr. Romano’s home have an accident on the Clubhouse-owned strip of land.
We, the members of the IPPOA, request that the fence be moved back to the property line without further delay to eliminate the liability issues and reclaim the 1,200+ square feet of Clubhouse property that Mr. Romano has claimed is his.
