Having suffered an unforseen injury during my 3 month probation period which left me on crutches I found myself worrying about my new job and how secure I was. I was told by 3 different doctors not to drive and that the healing processes could take months, with my employer not being flexible and not allowing me to work from home I was at risk of losing my job and with no legal rights to fall back on.
Being told I must come into the office I had to think fast about how I was going to travel over 20 miles to and from work without access to the best method of transport I had. Public transport would mean having to navigate train platforms at busy times, multiple stations, flights of stairs and crammed buses. Any doctor will tell you navigating those things whilst on crutches is not a good idea and a tumble, fall or knock could extend your healing time by weeks. Unable to work from home I felt lost, with no sick pay and a limited ability to get into the office made me worry financially. Like many people I cannot afford to lose a weeks, 4 weeks or 8 weeks pay.
As per the 'Dissmisal: Your Rights' page, section 4. on the .gov.uk website (https://www.gov.uk/dismissal) the minimum qualifying criteria that you must meet to take your employer to tribunal if you have been employed after 6 April 2012 is 2 years.
88,000+ claims for unfair/constructive dismissal were made between Apr '16 and Mar '17. An increase of 5000+ claims from the previous year however, how many claims are going unheard due to the '2 year qualifying period'? How many people are being unfairly treated and not being heard due to having no legal rights over their employer?
I am calling on the Secretary of State for Work and Pensions, David Gauke MP and the Minister of State for the Department of Work and Pensions, Damian Hind MP to review rights of employees that have suffered injury or illness during the first 2 years of employment and that they are treated no differently than if they had not encountered sickness or injury and to stop employers terminating employment contracts due to unforseen circumstances, especially during a probationary period.
