However, in Iowa, individuals as young as 18 can receive a sentence of Life Without the Possibility of Parole (LWOP). This means that a person, whose brain is still developing, can lose their entire life to a decision made in their youth.
Currently, in Iowa, you must be 21 years old to engage in numerous adult activities. Renting a car, purchasing alcohol and cigarettes, gambling, and running for state office all require a legal age of 21. Yet, for the gravest of sentences—LWOP—our laws permit this to happen to someone merely 18 years old. This inconsistency does not reflect our understanding of neurology and maturity.
Raising the age for LWOP sentencing from 18 to 21 in Iowa is a critical step we must take to provide a more just and humane legal system. Not only would this change allow for a second chance and hope of rehabilitation, but it would also align Iowa's legal frameworks with scientific insights about brain development. Under this proposal, individuals originally sentenced to LWOP would instead have the possibility of parole after serving a minimum of 35 years, permitting them the opportunity to demonstrate personal growth and remorse.
In countless cases, young people, barely adults, are condemned to die in prison without having the chance to mature, reflect on their mistakes, and contribute positively to society. By adjusting the age for such a severe sentence to 21, we allow more time for these young individuals to reform, thus fostering a system that values rehabilitation over punishment.
