I have seen my mother, friends and loved ones suffer due to the harsh reality of medical negligence in India, a scenario made graver by the apathy of various institutions towards these issues. These experiences have made it starkly clear how necessary it is to raise awareness about, and advocate for Patient Rights in our country, and make attempts to address and lessen medical negligence. 

India’s current healthcare infrastructure and system has proved inadequate in fostering patient safety. Statutory bodies tasked with regulating medical education and medical professionals have miserably failed in tasks mandated in their own mission statements and serve the interest of doctors and hospitals primarily. The justice system, heavily dependent on such bodies, is a helpless bystander.

The rot runs deep , as news everyday - including the very recent NEET examination scam- clearly shows.

Also, patients and their families are largely unware of their own rights. Some attempts have been made, such as the Indian Patient Rights Charter as developed by the National Human Rights Commission first set out in 2019 but this is yet to take a legal shape, and is perhaps deliberately suppressed by interested bodies.

Cases of medical negligence reported in the media are only the tip the proverbial iceberg. Many don't even reach the courts, and many lose, never to be reported in Media.

Fact is, a medical negligence case is a war amongst unequals, unlike most other legal cases. At one side is a layman patient and opposing him /her is a battery of well-funded lawyers, "experts" and other entities.

 Despite these, cases of medical negligence reported in media continue to rise. As well reported in this article :
— Annual medical malpractice in India hits 5.2 million cases.
— Incidences increased by 110%; litigation surged by 400%.
— Only 46% of providers follow ethical guidelines.
— 80% of medical error deaths are due to surgical mistakes.
— 70% of emergency fatalities stem from mismanagement.
— Highest malpractice rates in Punjab (24%), then West Bengal (17%), Maharashtra (16%), and Tamil Nadu (11%).

Under these very distressing situation, the government, healthcare institutions, and citizens must collectively work towards a goal where medical negligence reduces, and patient rights are upheld to the highest priority.

To make clear, this petition is NOT against ALL doctors - not at all ! Most are doing exceptional work in very trying situations, including a creaking health infrastructure and huge population. Most are ethical and have the patients' welfare their topmost concern. This petition aims to highlight and demand action for many situations - some of which may have nothing to do with the treating doctors- so that all are more aware, and ethical practices come to the forefront . Which , of course, can only be good for all !

रोगियों के अधिकारों और इलाज के दौरान लापरवाही के बारे में सार्वजनिक जागरूकता बढ़ाएँ !

मैंने अपनी माँ, दोस्तों और प्रियजनों को भारत में चिकित्सा लापरवाही की कठोर वास्तविकता के कारण पीड़ित होते देखा है।  इन मुद्दों के प्रति विभिन्न संस्थानों की उदासीनता ने इनको और भी गंभीर बना दिया है। इन अनुभवों ने यह स्पष्ट कर दिया है कि हमारे देश में रोगी अधिकारों के बारे में जागरूकता बढ़ाना तथा चिकित्सा लापरवाही को संबोधित करना और उसे कम करने के प्रयास करना कितना आवश्यक है।

भारत का वर्तमान स्वास्थ्य सेवा ढांचा रोगियों के लिए  काफी नहीं है।  चिकित्सा शिक्षा और चिकित्सा पेशेवरों को विनियमित करने का काम करने वाले वैधानिक संस्थान अपने ही मिशन को स्वरुप देने में बुरी तरह विफल रहे हैं।  ऐसा लगता है कि मरीज़ों को छोड़ वह मुख्य रूप से डॉक्टरों और अस्पतालों के हितों के लिए हैं।  कोर्ट्स की न्याय प्रणाली, जो ऐसे संस्थानों पर बहुत अधिक निर्भर है, एक असहाय दर्शक है।

मेडिकल करप्शन / भ्रष्टाचार बहुत ज़्यादा है ... जैसा कि हर रोज़ की खबरें - जिसमें हाल ही में NEET परीक्षा घोटाला भी शामिल है - स्पष्ट रूप से दिखाती हैं।

इन सबके साथ ही, मरीज और उनके परिवार अपने अधिकारों के बारे में काफी हद तक अनजान हैं। कुछ प्रयास किए गए हैं, जैसे कि राष्ट्रीय मानवाधिकार आयोग द्वारा बनाया गया मरीजों के अधिकारों का चार्टर  जिसे पहली बार 2019 में निर्धारित किया गया था।  लेकिन इसे अभी तक कानूनी रूप नहीं मिला है।   क्यों नहीं ? शायद  कुछ पार्टियां यह नहीं चाहतीं।  

मीडिया में रिपोर्ट किए गए चिकित्सा लापरवाही के मामले तो बहुत छोटा अनुपात  हैं।  कई तो अदालतों तक भी नहीं पहुँच पाते, और कई हार जाते हैं, जो कभी मीडिया में रिपोर्ट नहीं किए जाते।

सच्चाई यह है कि चिकित्सा लापरवाही का मामला अन्य कानूनी मामलों के विपरीत असमान लोगों के बीच युद्ध है। एक तरफ आम मरीज है और उसके सामने अच्छी तरह से वित्तपोषित वकीलों, "विशेषज्ञों" और अन्य संस्थाओं का एक समूह है।

इन सबके बावजूद, मीडिया में रिपोर्ट किए गए चिकित्सा लापरवाही के मामले बढ़ते जा रहे हैं। जैसा कि इस लेख में बताया गया है:
— भारत में सालाना चिकित्सा लापरवाही के 5.2 मिलियन मामले सामने आते हैं।
— घटनाओं में 110% की वृद्धि हुई; मुकदमेबाजी में 400% की वृद्धि हुई।
— केवल 46% प्रदाता नैतिक दिशानिर्देशों का पालन करते हैं।
— चिकित्सा त्रुटि से होने वाली 80% मौतें सर्जिकल गलतियों के कारण होती हैं।
— 70% आपातकालीन मौतें कुप्रबंधन के कारण होती हैं।
--- पंजाब (24%), फिर पश्चिम बंगाल (17%), महाराष्ट्र (16%), और तमिलनाडु (11%) में सबसे अधिक ऐसे मामलें  हैं 

इन बहुत ही विकट परिस्थितियों में, सरकार, स्वास्थ्य सेवा संस्थान और नागरिकों को सामूहिक रूप से एक ऐसे लक्ष्य की ओर काम करना चाहिए जहाँ चिकित्सा लापरवाही कम हो, और रोगी के अधिकारों को सर्वोच्च प्राथमिकता दी जाए।

हम स्पष्ट करें कि यह याचिका सभी डॉक्टरों के खिलाफ नहीं है - बिल्कुल नहीं ! अधिकांश डॉक्टर बहुत ही कठिन परिस्थितियों में - जिसमें एक चरमराती स्वास्थ्य संरचना और बड़ी आबादी शामिल है - बहुत अच्छा काम कर रहे हैं । अधिकांश नैतिक हैं और रोगियों के कल्याण को अपना सर्वोच्च कार्य मानते हैं। 

इस याचिका का उद्देश्य कई स्थितियों को उजागर करना और उनके लिए कार्रवाई की मांग करना है - जिनमें से कुछ का तो इलाज करने वाले डॉक्टरों से कोई सम्बन्ध  भी शायद न हो - ताकि सभी अधिक जागरूक हों, और नैतिक व्यवहार सबसे आगे आएँ। यह निश्चित रूप से, सभी के लिए अच्छा ही हो सकता है!

आइए बदलाव की मांग करें। आइए हम भारत में एक ऐसी स्वास्थ्य सेवा प्रणाली बनाने में योगदान दें जो जीवन को सबसे अधिक महत्व देती हो और उसकी सुरक्षा करती हो। कृपया इस याचिका पर हस्ताक्षर करके इस मुद्दे को उठाने में हमारी मदद करें। हम सभी मिलकर चिकत्सा प्रणाली में  सुधार ला सकते हैं , ताकि हम और हमारे प्रियजन सेहतमंद रहें न  कि उसी प्रणाली  से पीड़ित हों  जो हमारी मदद के लिए है !
