In 2008, Allen Dale Smith, found himself ensnared in a legal battle that has stolen away the past 18 years of his life due to an unjust sentence. Allen has maintained his innocence from the very beginning. During his first trial, a mistrial was declared (hung jury), but in a 2008 second trial, a guilty verdict was reached, sentencing him to 25 years to life—consecutively with other convictions. Besides Allen’s cries of innocence, this trial was also marred by prosecutorial misconduct that was deemed harmless by higher courts.
Prosecutorial misconduct can undermine the fairness of trials, depriving defendants like Allen of their right to a just hearing. Numerous reports and studies highlight how such misconduct is one of the leading causes of wrongful convictions in the United States.
In 2022, Allen filed a clemency petition to the Kansas Prisoner Review Board and Kansas Governor, Laura Kelly. A plea that, if granted, would right many of the wrongs endured over these past years.
Since being incarcerated, Allen has consistently demonstrated the values God instilled in him, using his time to lead, mentor, serve others, and pursue personal and spiritual growth despite the challenges he has faced.
Allen has demonstrated an extraordinary commitment to leadership, service, education, and personal growth. From 2012 through 2025, he served on the organization's Board of Directors, holding all five elected positions and serving four separate terms as Chapter President.
As President, Allen worked closely with facility staff and played an active role in the daily operations of the organization, helping create opportunities for positive change and personal development among incarcerated men.
In 2015, Allen and twelve other members developed a mentoring program focused on helping young men gain new perspectives while learning the skills necessary to become better fathers, husbands, and community members. This program reflected his belief that growth, accountability, and mentorship can transform lives.
Allen has dedicated significant time to self-improvement and helping others. He has facilitated more than 100 hours of self-help classes for fellow inmates while personally completing 289 hours of educational and self-help programming.
His dedication has been recognized through numerous awards and achievements, including:
2013 New Member of the Year
2014 Board Member of the Year
2015 Board Member of the Year
2017 Community Service Award
2017 Lifetime Membership Award with the Post Rock Jaycees
2019 Recognition for Completing 289 Hours of Self-Help Classes
Outside of his Jaycee involvement, Allen continued to pursue educational and spiritual growth. In 2015, he graduated from Faith Builders International Ministerial Academy (FBIMA) with a B+ average.
Allen's record demonstrates years of leadership, mentorship, service to others, educational achievement, and a sustained commitment to personal development. Rather than allowing incarceration to define him, he has consistently chosen to invest in himself and the lives of those around him, leaving a lasting positive impact on his community.
We stand at a crucial juncture where rectifying past injustices is not just an act of mercy, but a necessary correction . Clemency or commutation for Allen is not merely about healing a broken family but about setting a precedent that the justice system can evolve to correct its misjudgments. It sends a message to the community that every voice, especially those wronged and silenced, matters in the grand tapestry of justice.
We urge the relevant authorities to carefully consider Allen's 2022 petition with the seriousness and urgency it deserves.
