Tyrone Johnson moves to vacate this judgment pursuant to CPL §440.10 (b), (d), (f) and (h). The primary bases for the motion are two meetings of the trial judge and assigned assistant district attorney which took place on December 12, 2002 and July 18, 2003, outside of the presence of the defendant and his attorney.
