Sports Integrity Initiative, a trusted UK based sports law reviewer,  has published a review of the recent survey into The Court of Arbitration for Sport (The CAS). 

 


You will recall the AFL Anti-Doping Tribunal, comprising two Australian judges and a barrister, threw out ASADA ‘s case because, in the tribunal’s words, it lacked an ‘evidentiary basis’.

 


ASADA then funded the World Anti-Doping Agency to prosecute the players in a fresh trial at The CAS which banned the 34 players for the 2016 AFL Season.

 


Well, no surprises in this CAS review; just look at these sub headings:

 


- Hiding from the European courts?

- A ‘court’ dominated by one party

- A who is who list with preprogrammed conflicts of interest

- Sports exceptionalism or despotism?

- Survey: a yes to arbitration, a no to the CAS

- Rarely fast and rarely low-cost

 

 

 

The perpetual problem here is: who regulates the regulators?

 


Justice for the 34 renews its call for an Independent inquiry into anti-doping with wide ranging terms of reference which allow all sporting bodies, all athletes, and all interested parties to make representations.

This is in the national interest, and it will help all athletes, not just the Essendon 34.
