In an article in The Age, 26 June 2013, Caroline Wilson stated: ”The AFL says Jobe Watson's confession about believing he had been injected with banned drug AOD-9604 has been unhelpful to the investigation in the Essendon supplements scandal”. Unhelpful to whom? Four months earlier, on 12 February 2013, the AFL had been provided with clear advice that AOD-9604 was not banned under S2 and thus Essendon players had no case to answer. In an article called ‘Evidence omitted from ASADA report on Dons’ printed in The Australian, 28 December 2013, Chip LeGrand confirms some of Watson’s testimony on thymosin/thymomodulin: “Watson….told ASADA investigators that Dank explained to him there was "good" thymosin and "bad" thymosin”. He said that Dank injected him with "good" thymosin, which he had understood to be Thymomodulin”. “In further evidence to ASADA, Watson described the bottle from which Dank administered his injection. His description is understood to match a bottle of Thymomodulin stored in Dank's fridge at Essendon and photographed by assistant coach Dean Wallis.” For information, Thymomodulin is an immunity booster that can be safely given to babies and is legal for athletes to use. Mr LeGrand continues: “Neither Watson's evidence about the bottle nor the photograph were included in the 400-page interim report, which also does not mention an electronic spreadsheet obtained by Essendon officials from Dank's computer showing a schedule of Thymomodulin injections given to Essendon players.” Mr LeGrand states: “The ASADA report...does not canvass the possibility that the players were given Thymomodulin”. In an extract from Mr Chip LeGrand's book ‘The Straight Dope’, he writes: “Jobe Watson follows every day of the (CAS) proceedings. He knows from day one the players were cooked. It seemed as though the hearing had just opened when Michael Beloff QC, a renowned sports law expert appointed by CAS to chair the panel, starts talking about penalties.” “None of the players called to give evidence appear to make a good impression. Their accounts of what happened at Essendon - not challenged when they provided them in formal interviews with ASADA and AFL Investigators in 2013 - are met with raised eyebrows and clearing of throats. They are accused of covering things up, of acting on Dank and Robinsons orders to hide what is going on from the club's doctor Bruce Reid, of failing to take basic steps of ensuring what they were taking was permitted.” “At one point during Watson's testimony, the Essendon captain abruptly stops mid response. Beloff has asked him a question but another of the CAS panelists, Romano Subiotto QC is carrying on a private conversation with one of the WADA lawyers. “We’re done”, Watson thinks to himself.” On January 13, 2016 Jobe Watson issued this brief media statement on behalf of the 34 Essendon players: "The decision announced by the Court of Arbitration for Sport to uphold WADA's appeal is devastating. We are struggling to come to terms with this decision, and feel it does not support the players' firm belief that we are innocent. Our legal team is conducting a thorough review of the decision and will explore any avenues available to us. The players would like to thank our families, our friends, our members and supporters for their unwavering support. We would also like to thank the AFLPA for their ongoing support throughout the last three years. We will not be making any further comment and ask the media to please respect our privacy during this extremely challenging period.” Later in his book ‘The Straight Dope’, Mr Chip LeGrand sums it up this way: “The biggest anti-doping case in Australian sport, and the careers and reputations of a generation of Essendon footballers, are determined by a guess.” Something is not right when the Court for Arbitration for Sport decision appears manifestly untroubled in finding all the players guilty, despite lingering, material confusion as to how that conclusion was reached.
