Provide promised facilities viz Club & Playground in Ramprastha Greens Vaishali Ghaziabad.

The Issue

Sector 7 & 8 of Vaishali Scheme of Ghaziabad Development Authority has been developed as an integrated township by M/s Ramprastha Builders Pvt. Ltd. under the name “Ramprastha Greens”. In the said integrated township, which has been divided into pockets, common civic amenities such as club, school, community shopping and wide roads have been promised to the buyers of the flats sold in the said township as per the prevailing building bye-laws and norms as evident from the sanctioned plans of the various pockets. Brochures and advertising materials of various housing complexes support the aforesaid averment. 

The layout plan sanctioned for the township has not been shared to the buyers of apartments/plots in the township. The development of the township has been done with the only aim of profit-maximisation and gross violations of sanctioned plans have been done. Large areas earmarked for roads or other facilities in the sanctioned plans of the pockets have been encroached.

The Federation of Ramprastha Greens RWAs and some public spirited residents have been trying to obtain the layout plan sanctioned for the township from the GDA, but all efforts have failed. Strangely, the building plans in the vacant plots of the township are being sanctioned by the authorities without adhering to the layout plan of the integrated township. Letters are not being replied by GDA. RTI Applications seeking copy of layout plan and details of action taken on letters have not been replied to for almost a year and second appeal with State Information Commission is pending. 

Through this Petition, we humbly request Hon'ble Chief Minister of Uttar Pradesh to:

A.    Instruct the GDA to provide to us a copy of the NOC for development of the Township, the layout plan of the Township and details of public amenities/facilities required to be provided by the developer.

B.    Instruct the GDA to remove all encroachments and rectify all violations of sanctioned plans.

C.    Instruct the GDA and the developer to provide all community amenities/facilities as per the sanctioned plans and/or development norms.

Instruct the GDA not to sanction/allow any further development till such time as all community amenities/facilities as per the sanctioned plans and/or development norms are not provided.
