Protect Vulnerable Children: Require Safeguards When Safety Warnings Are Overridden
The Issue
A young child in Indiana has tragically lost their life after being returned to a home despite prior concerns for their safety.
This devastating loss has shaken our community and raises urgent questions about how decisions are made when a child’s well-being is at risk.
Agencies like the Indiana Department of Child Services exist to protect children and provide recommendations based on investigations. When those recommendations identify serious risk, they must carry meaningful weight.
This tragedy highlights a critical gap in the system—when safety warnings are overridden without additional safeguards, vulnerable children may still be placed in harm’s way.
We are calling for immediate action to strengthen protections for at-risk children:
- Require an independent secondary review when child safety recommendations are overridden
- Mandate enhanced documentation and justification in high-risk return decisions
- Require regular, unannounced welfare checks for a minimum of 12 months following reunification in high-risk cases
- Conduct a policy review to ensure child safety remains the top priority in all decisions
No child should fall through the cracks when warning signs have already been raised.
We must come together to ensure stronger safeguards are in place to protect the most vulnerable among us.
