The Issue

Deschutes County has stated they cannot issue the permit that TDWD has requested. The county claims they do not own the land that the road right of way sits on and that they only have power to regulate the right of way. Since the county can't issue the requested permit, TDWD has asked that Deschutes County enter into an Intergovernmental Agreement (IGA) between TDWD and Deschutes County. This IGA would protect the water source by having Deschutes County not allowing and health hazards in the 100' well protection zone. TDWD feels this is a commonsense decision and why would Deschutes County not agree to this option. There are no legal reasons Deschutes County could not enter into this agreement... So will they? please contact your county commissioners to encourage them to agree to this IGA to protect your water source!

Your Water District is asking for community help in preventing hazards being placed near Terrebonne's water sources.
*OAR 333-061-0050(2)(a)(C) allows a public entity owner of the area
within 100 feet of a water supply well to issue a permit in lieu of the above required
restrictive easement. Such a permit “shall state that no existing or potential public
health hazard shall be permitted within a minimum of 100 feet of a well site.”
The Terrebonne water district has been working for almost two years to secure a permit from Deschutes County to protect our 4 wells, only
to be ignored. Deschutes County has since told us they could make us remove the district’s first well, which was drilled in 1911.
We feel it is important for the communities’ water source to be protected from any hazards.
TDWD is asking that you show your support and sign this petition and show Deschutes County that protection of your water source is important to
you and the community.
