Protect Our Environment ! Stop Sand Harvesting By Cartels In Kitui County
The Issue
The Constitution of Kenya provides for right to safe environment! Sand harvesting in Kitui exceeds the legally permitted limits making it environmentally hazardous. As a result, environmental degradation through deforestation and soil erosion have all impacted the county negatively. The National Environment Management Authority (NEMA) has established regulations to control natural resources excavation in conjunction with the ministry of environment and natural resources in the country. Enforcement is necessary, especially since some functions of environmental management/Natural resources harvesting have been devolved to local governments.
Article 42 guarantees the right to a clean and healthy environment and requires the environment to be protected for current and future generations. Article 69 provides for the sustainable use, management and conservation of natural resources to ensure equitable sharing of accruing benefits, and Article 70 reinforces the right to a clean and healthy environment and provides a means for enforcement action and compensation for those deprived of this right.
We call on the Kenyan national Government and in particular Kitui County Government and other ASAL counties to take immediate action:
1. Through the National Environmental Management Authority (NEMA) / Environmental management and co-ordination Act 1999, relevant County departments enforce natural resources excavation (sand harvesting) laws and regulations to ensure that those licensed operate within acceptable and existing laws.
2. The the Kitui County Government and The National Environmental Management Authority (NEMA) develop and implements guidelines and best practices for sand harvesting to manage and minimize the impact on nearby residents.
3. The Kitui County Government and The National Environmental Management Authority (NEMA) conduct regular monitoring and inspections to ensure compliance with environmental regulations.
4. That The Ethics and Anti-corruption Commission (EACC) conduct thorough investigations with a view of charging those culpable of the illegal sand harvesting in Kitui County.
