It was difficult to tell this story, as we've tried to move forward and provide some normalcy in what seemed to be something we could overcome. And now we've decided to tell the truth about what is going on, in a city, and a system, that seems to be designed to ruin the lives of children, and their loving, protective mothers, and families.

A lot has happened since we created the petition 6 months ago, and never shared it. It's time to speak out.

Our hearts are heavy as we launch this petition to void the the fraudulent, unconstitutional custody order that granted sole custody of our granddaughter to a racist, serial rapist, who violated our daughter in her sleep and impregnated her against her will — on the first night they met in person.

This man has a history of sexual violence against our daughter, a sexual fetish for people sleeping or unconscious, and has threatened to abduct and harm the baby on multiple occasions.

We've fought tooth and nail to protect our daughter and granddaughter, but the system has failed us at every turn. Police filings have disappeared, and all of our evidence has been suppressed and unheard. His verifiable lies have overshadowed our daughter's well-documented truths.

He has yet to be held accountable for his numerous crimes against our daughter, yet a court is trying to give him custody, for no lawful, legal or justified reason. What makes this even more unbelievable is that he ADMITTED, UNDER OATH, that he is being criminally investigated for 2 sexual assaults against our daughter.

Our daughter has been traumatized, retaliated against, stalked, and terrorized by this man and his family for over two years. They've succeeded in terrorizing and traumatizing her, and now they’re trying to traumatize our granddaughter — and now his lawyer and law enforcement have become accomplices to this harassment, as their aiding, abetting and covering up of his crimes makes them complicit in them. We were actually being ILLEGALLY STALKED by detectives from the sheriff's department. To make things worse, they enlisted the help of citizens in the Community to further their crimes and aid them in the harassment and stalking.

The rampant corruption is shocking.

The Judge is actively involved in the deceitful actions of the lawyer and her client by not only approving their false claims but also allowing subsequent fraudulent requests that falsely portray our daughter as the culprit. This complicity is evident in the orders and the absence of legal grounds for the fabricated allegations.

We can't stand by and watch this happen any longer. This story has many more untold layers, but we are at a breaking point and fear that they will continue deliberately weaponizing the system against our daughter, who is horrified and living in fear — we live in fear for our daughter and granddaughter, not knowing what they’ll attempt next, as they believe they’re above the law -- and law enforcement and the "legal" system have given them that impression by not holding them accountable for their actions.

Our daughter is a devoted mother who has never harmed her child and has always prioritized her well-being, above everything else. She's taken great care of her daughter without any help from her abuser and has gone above and beyond to provide her with a safe and nurturing environment.

However, when our daughter tried to advocate for her child's safety, she was met with a cruel twist of fate. The judge retaliated against her by changing the custody ruling, giving the abuser sole custody and limiting our daughter to just two hours a week of supervised visitation — with her own child.

Our granddaughter doesn’t know this man or his family. Why would anyone, in good conscience, make such a harmful ruling? -- with no evidence that a loving, devoted mother is ANY harm to her child; and with verifiable evidence that the person you’re trying to transfer custodianship to IS of grave danger to the child’s well being. According to Texas Family Law that’s NOT in the best interest of a child—under the age of 3 -- let alone 1(she had just turned 1 at the time we created the petition) — or ANY CHILD for that matter. 

This decision of Judge Yahara Lisa Gutierrez is a grave injustice and a clear violation of our daughter's (and granddaughter's) human, parental and constitutional rights. She has done everything in her power to protect her child from harm, and yet she is being punished for it. Our daughter is not, and has never been a threat to her child, herself, or anyone else, and yet the court has treated her like a criminal. It's a heartbreaking situation that no parent should ever have to endure; and no parent should have to watch their child and grandchild go through.

It breaks our hearts to say that our daughter is not the only mother in El Paso who has experienced this judge's bias and unfair treatment. There is a pattern and history of her doing this to women, and it's time for it to stop.

We can't allow our justice system to continue to fail survivors and their children. It's time to demand accountability and reform from those in power. They deserve judges who will act fairly and impartially, not those who perpetuate systemic bias and discrimination.

Our daughter's resolve is unbreakable. She can not surrender her child to the man who has repeatedly sexually assaulted her and has threatened to do the same to our granddaughter. She's facing an unconstitutional court order that has infringed upon her parental rights and her freedom, in every possible way, but she's not backing down.

The very thought of handing her child over to a man who has threatened her child and caused her so much pain and trauma is unbearable. And even in the face of adversity, our daughter remains steadfast in her determination to protect her child and uphold her constitutional and parental rights.

We stand by our daughter's decision as we fight alongside her to ensure that justice is served. No parent should be forced to give up their child to an abuser, especially when their parental rights (and rights as a sexual assault survivor) have been violated in such a blatant and egregious manner.

We refuse to let our daughter's voice be silenced by a corrupt and broken system. The El Paso, Texas courts and law enforcement are trying to suppress her, and we want to send a clear message that survivors of sexual assault and abuse will not be silenced, and their voices will be heard.

Our daughter and her child deserve better, and we can't stand by and watch as our daughter and her child are terrorized and traumatized by this man, his family, his lawyer, and corrupt system.

Our daughter has done everything in her power to protect her child, and it's time for the system to acknowledge the facts and take action to ensure their safety.

We've launched this petition to compel the judge to revoke her egregious custody order and put our granddaughter's safety first. No child should be put in the arms of someone who has committed multiple criminal acts against their mother, and who has threatened harm towards them. It's a gross miscarriage of justice, and we won't stand for it any longer.

We urge you to support our cause and stand with us in our fight for justice. Together, we can send a powerful message that parental rights are not to be infringed upon, and that sexual abusers should not be given custody of a child.
