
In follow up to the Toronto Catholic District School Board holding a vote on August 20th, 2020, that resulted in Trustee's not being in breach of their Code of Conduct, interest has grown around how it was possible that the decision was ultimately made by the same four Trustees that voted against Ontario's Human Rights laws in November of 2019. It is suspected that the decision was made in bad faith, although trustees are called on to respect and comply with all applicable federal, provincial and municipal laws; as well as demonstrate honesty and integrity in their roles.
After an external investigator's report on complaints was delivered to trustees, it has been kept private from complainants and the public against the Ontario Education Act. Complainants were merely directed to Ontario Eduction Act Section 207 (2), and not provided with the subsection (a-e) that trustees had decided to invoke on amongst themselves.
Former TCDSB Student Trustee and member of the LGBTQ+ community, Kyle Iannuzzi, voiced his concerns to the board on October 15, 2020. He brought attention to the fact that “we know it is prohibited by law for organizations providing public services to ignore or fail to address human rights matters, even without a complaint." Trustee Lubinski later objected citing her point of order being “this is not a dictatorship here,” further proving there is still unresolved flippancy in respecting the rule of law, code of conduct and decorum at board.
In solidarity with Kyle Iannuzzi's concerns, we further request that the new Director of Education, Dr. Browne, inform the Deputy Minister of Eduction that trustees may have been unlawful in decision making.
