The Issue

A new Nevada law lets insurance companies remove wildfire coverage from homeowner policies—and that should concern every homeowner in the state.

Passed unanimously by lawmakers and signed by Governor Joe Lombardo, AB376 allows insurers to "carve out" wildfire protection and offer it through separate or experimental policies. While supporters say this will help keep insurance companies in the state, consumer advocates warn it could leave Nevadans with hollowed-out coverage and no real protections when the next major fire hits.

In 2023, nearly 5,000 Nevadans were denied homeowner insurance because of wildfire risk. But allowing companies to exclude wildfire protection isn’t a solution—it’s a retreat. It passes the risk onto homeowners while giving insurers more flexibility to limit their responsibilities.

This isn’t just a technical change. This is about the future of living in fire-prone areas, especially in Northern Nevada and forested communities already threatened by wildfire. Without strong protections in place, families could be one fire away from financial ruin—even if they thought they were insured.

We’re calling on the Nevada Division of Insurance and state lawmakers to:

  • Require clear, upfront disclosures if wildfire coverage is not included
  • Provide stronger oversight of “sandbox” policies that limit coverage
  • Explore creating a FAIR Plan to provide last-resort insurance options for high-risk homeowners
  • Hold insurers accountable for serving all Nevadans—not just the low-risk ones

Insurance exists to protect us from disaster—not to disappear when we need it most.
